28 Att a County Court held for their Royall Maties. William and Mary. King and Queen of England, Scotland ffrance and Ireland &c This 14th. day of January in the first yeare of their Maties. Reigne, and in the year of our Lord God 1689 Before their Maties. Justices thereunto Authorized and appointed for the County of Somerset. - - - - - - - - - - - - - - Capt. David Browne Mr. James Round Present Mr. ffrancis: Jenkins Mr. Samuel: Hopkins Capt. John: Winder Mr. Edmund: Howard Of the Coram Capt. Robert: King Mr. Thomas: Jones Mr. Stephen: Luffe The Court being Called,- - - - - - - - - - Imprimus. Came Before their Worps s. Roger Burkham under Sheriffe of this County and did openly declare that having Executed his office by serving a writt upon Matthew: Scarbrough the said Scarbrough in the audience of Sundry persons, viz: Wm: Whittington, John: Webb and Thomas: Oxford, said that he denyed the power now being, and therefore refused to obey. Whereupon the Court Ordered Sumons for the above said Whittington. Webb & Oxford to appeare next Court, as Evidences against the above said Scarbrough. The above said Roger Burkham at the same time retourns his pannel of Jury men viz twelve, of which did not appear, Richard: Chambers. Randall: Revell. William: Harris and Alexander: Thomas. for which their Contempt, the Court orders them to be fined, and summons to appear next Court to shew cause if any And then the Sheriffe was ordered to sumons four other Jury men in their rooms, which was imediatly done & so the Jury was forthwith called. Whose names are as followeth. Charles: Hall. Capt: William Piper Samuel Handy. John: Bennet: William Clarkson. Jeffrey: Mitchell: Thomas: Oxford. Daniel Hast. John: Tarr-- Richard: Whitty John: Jones. and William Rounds. who being sworne upon the holy Evangelists,attend The Court Orders the Sheriffe to sumon another Jury, wch was forthwith retourned. their names? being as followeth. John: King. William ffosset. John: Parker. Edward:Dikes. John: Killane. Matthew Dorman. John: Strawbridge. George: Bayly. Thomas: Tyer. John: Smock. Benjamin: Deards & William. Denson. in stead of Lazarus Maddux. Whom the Court Ordered to be fined, and Sumoned to appear next Court to show cause, if any, for his contempt in not appearing as a Jury man &c Then was this following Indictmt. Read Their Maties Contr Somerset County Ss Jacob: Martin The Jurors for their Maties. being sworne upon the holy Evangelists at a Grand Jury held for the Body of this County the second tuesday in November last past, doe present and find that Jacob: Martin of this County Labourer hath most wickedly and felloniously stolen and Carryed away, One hundred pounds of wool, together with One hundred and Sixty pounds of Iron to the value of nine hundred ninety and nine pounds of Tobacco, in or about the month of August Annoq Domy 1689. being the propper goods of Ralph: Milbourne and Richard: Dennis of this County Saylors, which said goods were felloniously stollen and carryed away from a board their Sloop. Rideing in Pocomoke River, and within the Jurisdiction of this Court contrary to the sacred and divine Laws of Allmighty God, the good Laws and Institutions of this Province and against the publick peace, their Maties Attourney Craves Judgment may be entered against the said Jacob: Martin, according to Law in that Case provided &c. James: Sangster Clk Indt. The Defendant appears in his proppr person and pleads not guilty |
