29 The Indictment being read and the Evidences Sworne and Examined, before the first Jury. who received their Charge.----- having this following Deposition read to them -----Somerset County in Maryland Ss. These are to Certifie that this day came Sarah: Cale the Wife of Thomas: Cade. of this County Aged twenty seven years or thereabouts before us ffrancis: Jenkins and Edmund. Howard two of their Maties. Justices for the County aforesd and made Oath upon the holy Evangelist, that she ye Said Sarah did see Hannah: Martin the Wife of Jacob: Martin sometime in September last take out of her said husbands Chest seven bolts and Spikes and did heare the said Howard say that she did believe that these were the bolts and spikes that Ralph: Milburn and Richard Dennis made search for, which the Rogue (meaning her husband) had stollen and had hid that they might not be found, and further the said Deponant maketh Oath that when the sd Jacob Martin came home from his last voyage, Over the Bay, his Wife and he went - from the said Thomas Cales house with a small fardell of cloaths (as she thought) under his arme, and this Deponent asked his Wife why she did not speake to him to carry some wood to make a fire with. him and the said Hannah made answer that he was so cross he would carry none, but gave her young childe she had in her armes to this deponant to carry whilest she gott some wood to carry home her selfe whereupon this deponant asked him why he did not carry some for the fire, who made answer he could not for his bundle he had under his armes, upon which she bid him lett his Wife carry the bundle and the Childe, and he the wood, which he having yielded to Laid his bundle on a Stump and his Wife assaying to take it up found it so heavy that she said burne it this is heavier then Childe and wood too. upon wch this Deponant said lett me see and went to take it up but found it so heavy that she could not lift it and further sayeth not. - - - - - - - - - - - - - - Sworne before us y 11th. day of January 1689/90 Edmund: Howard: ffra: Jenkins The Jurors viz Charles Hall foreman retourns this following verdict - Wee the Jurors find guilty Jacob Martin for stealing of a pump boult and a peece of a Sloops pintle Charles. Hall. Whereupon the Court Orders the said Jacob: Martin to pay four fold which was adjudged to be fourty pounds of Tobacco. and find Security for his good behaviour and Court Charges. - - - - - - - - - - - - - - - - - - - - Then was this following Petition Read. To the honble. Justices of Somerset County now in Court Sitting - The humble Petition of James Inglish humbly sheweth that in March Court last past, your Worships was pleased for to bind yr Petitioner to his good behaviour dureing your Worships pleasure, your Petionr. Craves your Worps release and your petioner in duty bound shall pray. - - - - - which Petion to the said James Inglish was granted. - - - - - - - - - - - - - - - - - - Somerset County Ssc. The Jurors for their Maties being Sworne upon the holy Evangelists, at a Grand Jury held for the body of this County the second tuesday in november last past, doe present and find, Patrick Barry and John: fferguson on the Sabbath day of last past did most wickedly and prophainly abuse the said Sabbath by being drunk and fighting at the house of Isaac: Horsey in Annamessex which -----d --- and heinious Sin agt.
