(169) On your Petioner for the Managemt of the sd Orphant and Estate and yr Petioner as in duty bound shall ever pray &c Then was this following Petion proferred likewise To the worll. the Comissionrs of Somerset County, the humble Petion of John: Tarr Sheweth That whereas your petioner in June Court last moved your worps that if any Security given by Jones Admr to Tho: Profitt deceased might take some provident care to prevent the abovesd Admr from imbezling and wasting the Orphants Estate by bartering and swapping and such like dealings which was daily practice. but since cannot learn of any Security given now the said Admr fearing he might be cvalled to accot. for his trust reposed in him hath since the last Court absented himself not being capable to render accot of the abovesd Orphants Estate, Therefore yor Petioner humbly prays that your worps will please to grant that the care of the Child, and what small matter of Estate remains upon Survey may be referrd to your Petioner being ffather in Law to the sd Orphant yr Petioner giving Such security as your worships shall admitt of, And your Petioner as in duty bound Shall ever pray et cetera. Both Petions being Read and Considered by the Court, whose Opinion and Order it is, yt the above mentioned Orphant do still remain and Continue with William:Turvile. the Said Turvile giving security according to Law in Such cases required. Order that Robert Johnson take accompt of the above named Orphants Estate (viz) Edward:Proffitt . Son of Thomas: Proffitt of this County deceased, and make report thereof to our Sd Court Ordr. Sent to Johnson Somerset Ss. To the worll. their Maties Justices for the aforesd County. William:Anderson Sheweth that ye Estate of Josias Seaward late of this County standeth indebted to your Petioner the sum of eight hundred thirty seven pounds of tobacco and Caske:viz. 437lb. by his subscription on ballance of a former debt and 400lb. by the Assignment of a Bill past per sd Josias to one James Bennet - - for both which sums your petioner prayeth Order against the Execcutors of the sd Seaward (If such there be) Else agt the Estate with Cost, and he will as in duty is pray &c. These shall oblige me the subscriber to pay unto James Bennet or Order at or upon the tenth day of November (next) the just quantity of four hundred pounds of good tobacco in Caske As Wittness my hand this 7th. day of July ano. 1688 Being present Josias:Seaward. George: Seaward his Richard: W. Wharton marke. - - - - - - - - - - Know all men by these presents that I James Bennett do Assign over to Thomas Ocford all that is mentioned wth in this Bill as Wittness my hand this 8th. day of January 1689 --------- - - - - - - - - - - - - James: Bennett Wittness C Nathaniel: Abbott Martin Trautham} I Thomas: Ocford wthin mentioned do Assign and sett over the within mentioned debt of four hundred pounds of tobacco and Caske to William: Anderson or Order warranting the same to be justly due as wittness my hand this 13th day of (July) 1689/0 the marke of John: J.P. Patrick Perkins Thomas: TO. Okford Wittness. Patrick. P. Barry. his marke. his marke I the Subscriber do acknowledge my Selfe indebted unto William Anderson or Order the sum of four hundred thirty (seven) pounds of tobacco to be well quallified and in Caske to be pd on reasonable demand to which payment I bind myselfe my Heirs.
