(150) Maryland Know all men by these presents that I Thomas Cale of the County of Somerset Planter / doth acknowledge my selfe my Heirs. Execcutors, Admrs and Assigns to stand justly indebted unto Tho: Newbold his Heirs or Assigns the full and just quantity of thirty Cutts of good Cypress: Timber to say eight quarters to the Cutt;, and each quarter to make ten good Covering boards eight inches broad, and three quarters of Inch thick to be paid upon demand and to be delivered at the sd Newbolds Landing in Pocomoke for which I do acknowledge to have received full satisfaction for the same, the Said timber not to be rotten, winding nor Eating timber, In wittness whereof I have hereunto Sett to my hand and seal this 10th. of October. 1689. his Wittness. Somerset County Ssc. ----- Jno: Jones was attached to answer unto ffrancis agt. Jenkins in a plea of trespass upon the Case &c. - - - - - And whereupon John: Jones: Defendt the sd ffrancis for him Selfe complains that whereas the said John the 5th day of June in the year of or Lord 1689 at Pocomoke within the Jurisdiction of this Court was indebted to the sd ffrancis the sum of One thousand five hundred eighty four and a halfe pounds of tobacco as pr a perticuler accot. thereof here in Court to be produced may appear, and the Said John: to the said ffrancis in manner aforesd being indebted, did assume upon himselfe and to the sd ffrancis faithfully promise that he the sd John the sd Sum of 15842 Pounds of tobacco to the sd ffrancis would well and truly Content and pay, Nevertheless the said Jno. his promise and assumption aforesd not regarding but minding and fraudulently intending him the sd ffrancis in this behalfe to deceive and defraud the sd sum of 1584&2 Pounds of tobacco to the sd ffrancis as aforesd hath not paid but hath hitherto refused and doth still refuse to the damage of the sd ffrancis of three thousand One hundred and Sixty Pounds tobacco & thereof he bring his Suit &c Pledges pr--- John: Doe Rich: Roe.
