14 Mr. Andrew Whittington Plt agt. Continued - James: Barry Defdt. - - - - Somerset County Ss.. James: Barry Tanner late of this County was attached to answer unto Andrew Whittington Innholder in a Plea of Debt &c ---- And whereupon the Plaintife by Thomas: Poole his Attorney comes and sayeth that he the said James upon the 23d day of May in the yeare of our Lord 1687 became indebted unto the Plt. the full and just sum of One thousand eight hundred and ninety pounds of good sound Merchantable Tobacco and Caske to be paid upon demand as will in Court more plainly appeare as by Bill under the hand and Seal of him the sd James bearing date as aforesaid and here in Court produced But he the said James fraudulently intending the Plt. to deceive of the sum aforesd of 1890lb. of Tobacco doth deny to pay the same although often thereunto required by the Plt. whereupon the Plt: saith he is damnifyed and hath damage to the value of 3500lb. of Tobacco and thereupon brings this suite. ----------------------- Pledsr. James: Barry Tanner late of this County was attchd to answer unto Andrew: Whittington Innholder in a Plea of Debt. ---------------- And whereupon the Plt. by Thomas: Poole his Attorney comes and sayeth that he the said James in the yeare of our Lord. 1687. became indebted unto the Plt. the full and just sum of two thousand five hundred pounds of good sound Merchntable Tobacco to be paid in good suffitient well Tanned Leather at the prise current in Somerset County according to Act of Assembly at or before the 10th. day of October according to the tenour of two Bills which we have here in Court to produce under the hand and seale of him the said James bearing date as aforesaid, wherein he the said James did bind him selve his heirs. Executors or Admrs. to pay the same as aforesaid unto the Plt. his heirs Extrs or assigns or Lawfull Attorney or Order, But he the said James. fraudulently intending the Plt. to deceive of the sum aforesaid doth deny to pay the same although often thereunto required by the Plt. whereupon the Plt. saith he is damnifyed and hath damage to the value of five thousand pounds of Tobacco and thereupon brings this suite Pledgr.Deprs.
