13 Bringeth his suit &c. Pledg et Jo: Doe Ri: Roe And he brings here into Court the Ld: Testamentary John: Vigorus. Admr to Ann: Smith. Plt. agt. Continued pr Plts. Attorney William Richardson Dfdt. - - - Somerset County Ss. William: Richardson of Somerset County was attached to answer unto John: Vigorous Admr of the goods and Chattels of Ann: Smith decd who was Executrix of the last Will and Testament of Edward: Smith deceased in a plea of trespas upon the Case . - - - - - - - -And whereeupon the said John by Peter Dent his Attorney sayeth that ye said William ye 10th. day of May in ye yeare of our Lord. 1685 at Monocon within the Jurisdiction of this Court was indebted to the said Edward in his life time the sume of five hundred pounds of Tobacco being in Consideration that ye sd Edward would acquit one William Winslow of the said sum of five hundred pounds of Tob: which he was indebted to him and accept of him the said William Richardson for pay did assume upon himselfe and to the said Edward: Smith then and there faithfully promise that he the said William Richardson the sd sum of 500 pounds of Tobacco. to the said Edward Smith when he should be thereunto requested would well and truly content and pay Nevertheless the said William: Richardson his promise and assumption as said not regarding but minding and fraudulently intending the said Edward in his life time and the said Ann - after his death and the said John since the death of the said Edward and Ann. to whome Admr. of all and singular the goods and Chattels which were of the said Ann at the time of her death after her death by the Ld. Propryoy. was committed the said Sum of 500lb. of Tobacco. or any part thereof to the said Edward in his life time or to the said Ann after his death or to the said John after the death of the said Edward and Ann. hath not paid although the said William Richardson afterwards the day and place afd by the said Edward in his life time and by the said Ann after his death. Executrx afd. and by the said John Admr. of the goods and Chattels afd hath been. requested but hath hitherto refused and doth still refuse to the damage of the said John of 1600lb. Tobacco. and thereof he bringeth his suit &c. Dent pr quer. Pledger: John: Doe. Rich: Roe. Capt. Henry: Smith Plt. agst. Continued upon Non-appearance Henry: Smith. Planter Dfdt. Somerset Ss. Henry Smith Planter was attached to answer the suite of Henry Smith Merchant in a Plea of trespass upon the Case. And the said Henry by his Attor.ney Thomas Poole saith that in the yeare of our Lord God 1687 . the said defendant became indebted unto the said plaintife thefull and just sum of sixteen hundred and eighty pounds of good sound Merchantable Tobacco and Caske the which said sum of 1680lb of Tobacco hath been severall times demanded of the sd defendant but he fraudulently intending refuseth to pay the same whereby the plaintife is damnifyed and hath damage to the valew of 3000lb Tobacco. and thereupon brings his suite Thomas Poole pr quer Pledges.Depr.
