(130) June 14th. 1690 John: Loader Plt Walter Lodge of Somerset County was Sumoned to answer unto Jno - - - - - - - - agt. Loader of a plea that he render unto him six thousand eight hundred Walter: Lodge dft fourty four pounds of tobacco which to him he oweth & unjustly - - - - - - - - deteineth. &c. And whereupon the sd John by Peter Dent his Attorney saith that the said Walter in the year of our Lord 1688. att Monokin within the Jurisdiction of this Court was indebted to the sd John in the said sum of six thousand eight hundred and fourty four pounds of tobacco, by his certain Bill Obligatory acknowledged himselfe to stand indebted to the sd John in the said sum of 6844 Pounds of tobacco Nevertheless the said Walter the said Sum of 6844 Pounds of tobacco of tobacco and Caske although often demanded the same to the said John hath not rendred but hath hitherto denyed and doth still deny to the damage of the sd John of 10000 Pounds of tobacco and thereof he bringeth his suit &c. Somersett County Ss // Richard: Hill Blacksmith agt. was attached to answer unto George Nicholas Hack Richard: Hill Blacksmith. Deft. of a plea of trespass upon the Case &c. And whereupon the sd George Nicholas Hack by Peter Dent his Attorney complaineth that whereas the sd Richard the 13th day of June in the yeare of our Lord 1686. at Monokin within the Jurisdiction of this Court was indebted to the said George the full and just Sum of Sixteen hundred and eighty pounds of good sound Merchantable tobacco and Cask as by a certain note Subscribed with the proper hand of him the said Richard here in Court ready to be produced more at large may appear, and the sd Richard to the sd George in manner aforesd being indebted the sd Richard in Consideration thereof did assume upon himselfe and to the sd George then and their faithfully promise that he the sd Richard the sd sum of 1680 Pounds of tobacco to the sd George at or upon the last day of October next ensueing the date of the sd note would well and truly Content and pay, Nevertheless the said Richard his promise and assumption asd not regarding but minding & fraudulently intending the said George in this behalfe Craftily and Subtilly to deceive and defraud the said Sum of 1680 Pounds of tobacco to the sd George hath paid although the sd Richard to doe the same by the sd George after wards was requested but hath hitherto refused and doth still refuse to the damage of the sd George of 2400 Pounds of tobacco and thereof he bringeth his suit &c.
