Issue being thus joynd and referred to a Jury, whose names are as followeth (viz) Capt. Wm: Coulborne

John Vigerous. Simon Perkins Junior. Richard: Tull: Richard: Hill. William: Bowen. Edward: Harper
Cornelius Ward. Robert: Catling: Samuel: Shewel. John Carter. Adam: Hitch. who being legally
impannelled and sworne having heard the whole matter, receives their charge and goes forth -----
Who
being returned brings in this following verdict, which is Ordered to be entered. Viz. Wee the /
Jury find for the defendant, William: Coulborne. forem. - - - - - - - - - -

Thomas Dixon. Plt. Somerset County Ss // Joseph ffreeman late of Somerset County
agt. was Sumoned to answer unto Thomas Dixon of a Plea that he
Joseph Freeman. Deft ` render unto him One thousand nine hundred pounds of good
sound
Merchantable tobacco and Caske, which to him he oweth &
unjustly
deteineth &c.
And whereupon the sd Thomas by Peter Dent his Attorney saith that the sd Joseph the 25th day of
May in the year of our Lord at Monocan within the Jurisdiction of this Court by his certain bill
obligatory which the sd Thomas with the seal of the sd Joseph signed bringeth hereinto Court
the date whereof is the day and year aforesd acknowledged himselfe to be bound to the sd Thomas
in the sd just and full Sum of One thousand nine hundred pounds of tobacco and Caske to be paid to
the said Thomas upon demand at some port or place in the sd County to the which payment well
and truly to be made, the sd Joseph bound himselfe firmly by the sd Bill, Nevertheless the sd Joseph
the sd Sum of 1900 Pounds of tobacco to the said Thomas although often demanded the same to
the sd Thomas hath not rendered but hath hitherto denyed, and still doth deny to the damage of
the sd Thomas of 2800 Pounds of tobacco and thereof he bringeth his Suite &c.

Declaration being Read // this following accompt Bill was then produced ( viz)
This Bill bindeth me Joseph ffreeman of Somerset County my Heirs: Execcutors Admrs
to pay or cause to be paid unto Thomas: Dixon of the same County his Heirs, Execcutors
Admrs or Assigns the just and full Sum of One thousand nine hundred pounds of good
sound Merchantable tobacco and Caske to containe the same to be paid upon demand at some
port or place of dilivery in the aforesd County as wittness my hand and seal this the 25th ---
day of May 1688. Joseph: ffreeman. ?
