Mr. James Round Mr. Samuel: Hopkins: mr. Thomas: Newbold. Mr. Edmund: Howard. Mr. George Layfield. - - - - Jacob Martin Plt. Somersett County Ss / mr. Edmund: Howard late of this County was agt Sumoned to answer unto Jacob Martin of the same County in an Mr. Edmund Howard Dft.action of the Case and whereupon the plt by his Attorney, Edward Jones, comes and sayes that Sometime in August last past that the plt Jacob: Martin was taken by a warrant to make his personal Appearance before some Justice of this County and was brought before mr. Edmund Howard. defdet who did detain the sd plt a prisoner till the second tuesday in November last at his owne house and his Ants house, never comitting the plt to the Custody of the Sheriffe of this County according to law in that Case provided, by which false imprisonment the plt saith that he is damnified to the value of ninety five pounds sterling money, and thereupon brings his Suit John: Doe Rich Roe pledges of not guilty and putts himselfe upon the Country. Dent presecuting and the plt also. / Jones The abovesd declaration being read and the Evidences sworne and examined, before the Court and Jury which Jury was duely impannelled and sworne whose names are as followeth viz Capt. William: Coulborne John: Vigerous Simon. Perkins Junior, Richard: Tull. Richard: Hill. William Bowen. Edward: Harper. Cornelius: Ward. Robert Catling. Samuel: Shewel: John: Carter Adam: Hitch. 12 / who having recd their charge goes forth --- And being retourned brings in this following Vertict. Wee the Jury find for ye defendt 3 Evid/ sworne for plt. William: Coulborne forman this was tryed 13th day June. after John: Taylor was made incapble of pleading the sd Taylor was Attorney and should have pleaded - - - - - - - - - - Martins cause but was dissanulld and after the sd Martin was Cast pr Jury. he complained of Jno. Taylor telling the Court that he had never prosecuted mr. Howard but for John. Taylor who induced him thereto. Upon Complaint made by Stephen Costin and John. Bennett, that mr John: Strawbridge doth not doe justly by James ffurnish Orphant & Sonn of William ffurnish deceased, the Court admitts the sd James to chuse his guardian, who make choise of Stephen Costin, Which sd Costin accepted, and promisses this Court to keep the said James att school till such times as the Court shall think fitting - - - - - - - - - - - - - - - Elizabeth: ffurnish daughter of William ffurnish deceased humbly prayes that she may chuse her Guardian, she being fifteen years of age, which is granted, she chussing the aforesd Costin for her Guardian, which he accepts To their Maties.
