(115) To the Worshipfull Justices of Somerset County now in Court Sitting, the humble Petion of Richard Chambers & Stephen Costin who are the securities for the Estate of Wm: ffurnish in the Chancellors Office findeth that the Estate is every day wasting, and John Strawbridge, who maryed with Honor ffurnish doth refuse for to give Bond for to bear harmless and save indempnified the above sde Petioners who humbly Craves that the Estate may be removed out of the hands of the abovesd John Strawbridge by reason that he seeks for to defraud the ffatherless Children and for to damnifie the securities in regard that he hath recorded a marke for his owne sonn and doth marke all the increase of the Orphants stock that did belong to William: ffurnish in his owne sonns marke, And in so doing humble Petioner in duty bound shall pray. - - - - - - - - - - - - - - - - - Petion Read, but no full result was given - - - - - - - - - - - - - - Order process Issue forth upon Grand Juryes presentments. - - - - - - - - - - - - - - - - - - - - To the Worll the Comissioners for Somerset County the humble Petition of George Latcham sheweth. That whereas your Petioner was bound to the good behaviour dureing the Courts pleasure and behaving my Selfe without shame humbly desires your Worships to Order the sd Bond to be canselled your Petioner living far distant from the Court cannot come againe without detriment, and your Petioner shall humbly pray. ----- Petion being read and considered, the sd George Latcham in Court was cleared by Proclamation. - - - - - - - - - - - To the Worll. the Comrs of Somerset County Court the humble Petion of John: Kirk humbly Sheweth That your Petioner hath lately understood that a writt of sceri facias was Issued agt him to appear at the last Court to shew cause why he did not comply with a certain judgment formerly obteined agt him as Admisr. to Edward: ffurlong of this County deceased, by mr. ffrancis Jenkins, but the said writt not being legally executed, your Petioner had not notice, untill the said Court was passed, so that he could not then appear, but is now come to make his appearance att ? this Court and hath brought the accompt of his Adminr to satisfie the sd Jenkins yor Petioner therefore humbly desires ye Worships may grant him a hearing this Court, and that the said Jenkins may have no advantage given him upon the sheriffs remissnesse in the exon of his Office, and your Petioner as in duty bound shall pray. - - - - - - - - - - The abovesd Petion being read, mr. ffrancis Jenkins than president in Court (told them) that he would not have the Court Surprised, saying that the Court allready had granted Order upon the retourne of that scieri.facias for Execution agt the sd Kirk. where upon Walter Laine in Open Court told the sd Jenkins that it was but a piece of designed knavery in him to take the advantage of John: Kirk, knowing him to be absent when the scieri facias was executed.
