(117) The sd ffountain and Davies Petion being read, the Court Orders the afore mentioned Child viz James: Davies Sonn of Margerett Davies, being four years old the thirteenth day of July next to be an Apprentice to the sd C Mearcy ffountain till he be at the age of One and twenty years, and at fifteen years of age the sd ffountain is to give to the sd James. a three yeare old heifer with calfe, the sd heifer and its increase to be kept with the sd ffountain till the sd James be free, the sd ffountain promises to learne him to read. - - - - - Somersett County in Maryland --- To the Worll. Justices of their Maties Peace for the County of Somersett. The Petion of John: Davies humbly sheweth that Randall Douglas and your Petioner agreed thirteen months since that I should keep a young Child for him for one year, which your petioner hath performed, but Randall Douglas hath runn away and hath left the Child with your petioner being a very poor man, your humble petioner Craves yr worships judgmt. therein, and craves your worships help, and your petioner as dutifull will ever pray . &c. - - - - - - Vide folio 100. - - mr. Executrx of the last Will and Testament agt of Coll. William: Stevens decd, of a plea of trespass upon the Case . - - - - - Simon: Perkins Senior defdt And whereupon the sd George and Elizabeth by Peter Dent their Attorney say that the said Simon the 27th. day of October in the year of our Lord. 1687, at Monie? within the Jurisdiction of this Court was indebted unto the said William in his lifetime in the sum of fourty shillings Sterling, for one steer before that time sold and dilivered, and the sd Simon, the sd William in manner? aforesd being indebted, the sd Simon in Consideration thereof did assume upon him Selfe and to the sd William faithfully promise that he the sd Simon the sd Sum of fourty shillings sterl. to the sd William, when he should be there unto requested, would well and truly content and pay Nevertheless the sd Simon his promise & Assumption aforesd not regarding, but minding and fraudulently intending him the sd William in this behalfe Craftily and Subtily to deceive and defraud the sd fourty shillings or any part thereof to the sd William in his life time or to the said Elizabeth after his death Execcutrx as sd while she was Sole nor to the sd George and Elizabeth Since the marriage between them had and solemnized, hath not paid although the sd Simon to doe the same hath been requested to the said William in his life time and to the sd Elizabeth since she was sole, and to the sd George and Elizabeth since their marriage, but the same to doe hath refused and still doth refuse to the damage of the sd George and Elizabeth of six pounds sterl. and there of they bring their suit. Dent. And they bring into Court the letters Testamentary of the sd Pledger: Jno. For William whereby it may appear to the Court the sd Eliz. to be Rich. Roe Execcutr. asd and thereof to have Administration. - - - - The abovesd Declaration being read both partyes joyne Issue referring the matter wholy to the Court who having heard the whole matter debated, as also the 2 Evidences for the defendt.
