(111) The Deposition of Thomas: Quillane Aged twenty Six years or thereabouts being sworne and examined saith yt this deponent did hear Nicholas: Hartnell in January Court last past say that he would pay Peter Whaples One thousand pounds of tobacco, in the hands of Capt. William Coulborne upon the accompt of Joseph ffreeman and further Saith not Thomas: Quillan. - - - - - - - -sworne to in Court - - - - - - The Deposition of Charles. Tindall Cordwayner aged 28 years or their abouts saith that when Nicholas: Hartwell was at worke at Peter Whaples his house he heard him severall times promise to pay Joseph ffreemans debt that he owed to Peter but espetially in December last at the sd house of Peter Whaples. Nicholas came to worke, where the sd Nicholas and Peter fell in discourse about the sd debt and the said Whaples & Peter did ask him if he realy intended to doe as he said he would forewarn Capt. Smith to pay the Bill Hartnell he had given Peter, and the sd Nicholas answered no not I. the said Peter asked him why he said so, then Nicholas answered it was only to vex him. then said Peter I must have all my tobacco this year of you or otherwise I will proceed agt Joseph, and Nicholas made answer if you goe for England I will See and gett you it all, but if you doe not goe I will make you stand to your agreement with me you and I made over the Bay, that is to pay you the Bill I gave ye of Capt Smiths this year, and the remainder next year & further sayeth not. Charles Tindall Sworne to in Open Court - - - - - - - - - - - - - - - C The Deposition of William: Piper sheweth that whereas I was one Arbitration with Matthew Scarbrough between Capt. Smith and Michael: Holland, and wee did agree that Capt Smith should pay unto Michael: Holland tenn thousnd two hundred pounds of tobacco and Caske, and that the sd Holland should pay unto the sd Smith fourty pounds - -- Barbadoes money, the sd Smith finding fault with the Award Matthew: Scarbrough took up the Award and made the tenn nine, which I the deponent said will not agree to itt, unless the sd Holland were Satisfied wch itt which is all I can say or swear. Smith, hapening with a mishap by the way between Edward: Hamons and Mr. William Rounds, my Cousons mare started and threw her downe, and put her Arme out of joynt, thereby being put by from Court not being able ride, this is to acquaint your Worships, that before wee the Subscribers Elizabeth Smith does make Choyce of Samuel: Shewel for her guardian as witness our hands this 9th. June 90. Ann: Hammon Director: Smith William Browne The Petion being Read the Court doth Order that Capt Samuel: Shewell bring Eliz. Smith to next Court to chuse her guardian. The aforesd Elizabeth Smith was borne the fourth of Aprill in the year 1676. as apeard writt in a bible, which the sd Shewell produced in Court, who Ordered to be recorded. |
