By the HOUSE of DELEGATES, November 21, 1796.

        GENTLEMEN OF THE SENATE,
    THIS being the day appointed by both houses for the purpose of electing a senator to represent
this state in the senate of the United States, in the room of Richard Potts, Esquire, whose seat is
vacated by his resignation, we propose immediately to go into a ballot for the same.  John Eager
Howard, Esquire, and Richard Sprigg, junior, Esquire, are put in nomination by this house.
    We have appointed Mr. Philip B. Key, and Mr. Daniel Reintzel, to join such gentlemen as you
may appoint to examine the ballots.
                                                            By order,                                W.  HARWOOD, clk.
    The clerk of the senate delivers the resolution respecting testamentary laws, endorsed; " By the
" senate, November 21, 1796:  Read the first and second time by especial order and assented to.
                                                            " By order,                              A.  VAN-HORN, clk."
    Mr. Carroll appeared in the house.
    Mr. Robins, from the committee, brings in and delivers to Mr. Speaker a bill, entitled, An
act to dispose of Eden School, in Somerset county, and to apply the money to the purposes therein
mentioned; which was read the first time and ordered to lie on the table.
    Mr. Clarke, from the committee, brings in and delivers to Mr. Speaker a bill, entitled, An act
for the more effectual collection of county charges in Allegany county; which was read the
first time and ordered to lie on the table.
    The clerk of the senate delivers the following message:
By the SENATE, November 21, 1796.
        GENTLEMEN,
    WE concur with your proposition of entering immediately into an election of a senator to represent
this state in the senate of the United States, in the room of Richard Potts, Esquire, resigned,
and have appointed James Hollyday and John Chesley, Esquires, to examine the ballots, in conjunction
with the gentlemen mentioned in your message.  No gentleman is named in the senate in
addition to those nominated by you.
                                                            By order,                                A.  VAN-HORN, clk.
Which was read.
    Agreeably to the order of the day the house proceeded to ballot for a senator to represent this state
in the senate of the United States, to supply the place of Richard Potts, Esquire, resigned, and the
ballots being deposited in the ballot box, the gentlemen named to strike retired, and after some
time returned and reported, that John Eager Howard, Esquire, had a majority of votes of all the
attending members of the legislature.
    Whereupon, RESOLVED, That John Eager Howard, Esquire, be, and he is hereby declared to
be, senator to represent this state in the senate of the United States.
    Mr. Hollingsworth, from the committee, brings in and delivers to Mr. Speaker the following report:
    THE committee to which was referred the petition of the levy court of Cæcil county, report,
that they find the facts to be as stated in said petition, and are of opinion that a law ought to pass
in conformity thereto.
                                                            By order,                                J.  HARWOOD, clk.
    Which was read the first and second time, concurred with, and leave given to bring in a bill
pursuant thereto.  ORDERED, That Mr. Hollingsworth, Mr. Barroll and Mr. Wallace, be a
committee to prepare and bring in the same.
The house adjourns till to-morrow morning 9 o'clock.

T    U    E    S    D    A    Y,    November 22, 1796.

    THE house met.  PResent the same members as on yesterday.  The proceedings of yesterday
were read.
    The order of the day, respecting the constitutionality of the election of James Carroll, a delegate
returned for Baltimore county, is postponed until Monday next.
    ORDERED, That the sheriff of Baltimore county, or his deputy, appear before the house on
Monday the 28th November instant, with the original poll taken for Baltimore county, at the late
election held in October last, for delegates to represent said county in the general assembly of Maryland.
    Petitions from Nathaniel Lock, Robert Shaw, of Baltimore-town, George Johnson, of Somerset
county, and George Matthews, praying acts of insolvency, were preferred, read, and referred to
the committee on petitions of a similar nature.
    Mr. Robins, from the committee, brings in and delivers to Mr. Speaker the following report:
    THE committee to whom was referred the petition of sundry inhabitants of  Dorchester county,
report, that they have taken the same into consideration, and find the facts therein stated to be true,
and your committee are of opinion a law ought to pass opening a public road agreeable to the prayer
of the said petition.  All which is submitted.

Which was read.
    Mr. Brown, from the committee, brings in and delivers to Mr. Speaker a bill, entitled, An act
to allow further time for collecting the balances due to Thomas O'Bryon, late sheriff and collector
of Queen-Anne's county, deceased; which was read the first time and ordered to lie on the table.
