Who may demand
books,
&c.

Proviso.
How vacancies
are to be
filled.
Court may fill
a vacancy,

Expence to be
paid. |
and after having taken an oath before one of the aldermen of the corporation
of
George-town, well and truly to execute the trust reposed in them by
this act
without prejudice, favour or partiality, to cause a correct survey
to be made of
one, two, three, four, five, six, seven and eight-streets, in Beatty
and Hawkin's
addition to George-town, having regard to the original design; and
to establish
and fix permanent boundaries, to cause a correct plot and certificate
of the same,
with proper explanations, to be returned to the clerk of the territory
of Columbia,
under their hands and seals, who is hereby required to receive and
record
the same.
III. And be it
further enacted, That the said commissioners shall have full
power and authority to ask, demand and receive of William Deakins,
junior,
and Charles Beatty, all books and papers they may have in their possession
relating
to the drawing of said lottery, the disposing of the lots, and the
laying out
of said addition; and they the said Deakins and Beatty are hereby required
to deliver
the same to them without delay, and to have such of them as the said
commissioners
may think proper recorded among the records of the territory of Columbia.
IV. And be it
enacted, That the said books and papers relating to the drawing
of the lottery, and the original laying out of said addition, as well
as those
relating to the survey hereby directed to be made, when so recorded,
or any attested
copy of said records, under the hand and seal of the clerk, shall be
good
evidence of the same, or any part thereof, in any court of law or equity
in this
state.
V. Provided always,
and be it enacted, That in case any building or improvement
shall interfere with or stand on any street, lane or alley, of said
addition
to George-town, according to the original location thereof, which shall
by virtue of this law be thrown into any street, lane or alley, the
same shall not
be deemed a nuisance, but may stand and be occupied by the present
owner or
owners, but shall not be rebuilt or repaired.
VI. Be it enacted,
That the mayor's court of George-town be and the same
is hereby vested with full power and authority to fill an vacancy that
may happen
by death, resignation or otherwise, in the board of commissioners aforesaid.
VII. And be it
further enacted, That the said mayor's court be and the same
is hereby vested with full power and authority to fill the vacancy
that has happened
in the board of commissioners mentioned in the act, entitled, An to
open a road from George-town to a bridge to be erected over the river
Patowmack,
at or near the Little Falls, by the death of Thomas Clarke, therein
named, and to fill any vacancies that may hereafter happen by death,
resignation
or otherwise.
VIII. And be
it enacted, That the expence arising from the execution of this
act shall be paid by the petitioner. |
