2996 CONSTITUTIONAL CONVENTION OF MARYLAND [Dec. 30]

DELEGATE GALLAGHER: It is al-
ready printed. It would not read beginning
on line 28, "The General Assembly shall
enact either the commission plan or a con-
gressional redistricting plan of its own".

THE PRESIDENT: Very well. We can
do it simply by voting against the Commit-
tee Recommendation, but since the amend-
ment is printed you might as well go
ahead.

Will the Pages please distribute Amend-
ment W ?

This is going to be confusing. No, do not
distribute W, please. Just simply call for a
separate vote on section 3.22. Otherwise it
will be very confusing.

Delegate Burdette.

DELEGATE BURDETTE: I wondered if
the Chairman of the Committee would con-
sider in that matter the word "enact" in
the original. I have no objection to his
motion whatever, but the word "enact" has
been used by the Committee on Style to
mean action only by the General Assembly,
but it leaves vagueness in terms. I am a
little uncertain as to whether or not it
means enact by law, or the General As-
sembly by law.

THE PRESIDENT: Delegate Gallagher.

DELEGATE GALLAGHER: What I
would prefer to do would be when we reach
3.22 on the seriatum consideration they will
decide it, and I will talk to you about it.

DELEGATE BURDETTE: All right.

THE PRESIDENT: Are there any fur-
ther amendments as to style?

The Chair has also previously announced
to a number of delegates, all that it could
find who were leaders on both sides of the
dispute as to single member districts, that
for the same reasons it would be desirable
to have the consideration of these sections
also made a special order of business
Tuesday.

In addition to the reasons given, we are,
I am very much afraid, running very close
to a flu epidemic. We are having more and
more delegates come down with a sudden
sore throat and fever. They appear to be
scheduled for recovery by Tuesday.

I think it is highly desirable that on
these issues where the vote is likely to be
close that we do it at a stated hour when
as nearly as possible all delegates would be
here, as otherwise we will simply have re-
considerations.

The Chair therefore at this time recog-
nizes Delegate Powers for the purpose of
moving that consideration of sections 3.03,
3.04, and 3.23 be separated from the Com-
mittee Recommendation LB-1, 2 and 3 and
made a special order of business for next
Tuesday.

Delegate Powers.

DELEGATE POWERS: Mr. President,
I believe that rather than a motion it is a
request and the request may be granted at
the discretion of the Chair. Therefore I
request that sections 3.03 and 3.04 of the
Committee Recommendation S&D-1G deal-
ing with LB-1 on the subject of composition
of the General Assembly and legislative
districts, be divided so that these two sec-
tions may be considered separately from
the remainder of the report.

THE PRESIDENT: The Chair rules
that it is divisible. They will be separated.

Did you cover also 3.23?
DELEGATE POWERS: No, I did not.
THE PRESIDENT: Very well.

DELEGATE POWERS: Now, Mr.
President, I further request that section
3.23 of the Committee Recommendation
S&D-16, General Application of Laws, be
divided so that this section may be con-
sidered separately from the remainder of
the report.

THE PRESIDENT: The Chair rules
that the section is divisible.

DELEGATE POWERS: I now move,
Mr. President, that sections 3.03 and 3.04,
as previously referred to, and section 3.23,
be made a special order for Tuesday, Janu-
ary 2, immediately following1 the matters
that have previously been made a special
order for 2:00 p.m. on that date.

THE PRESIDENT: Is there a second?

(Whereupon, the motion was duly sec-
onded.)

THE PRESIDENT: Delegate Johnson.

DELEGATE JOHNSON: Mr. President,
there is a technical problem that has been
created in the Suffrage and Election arti-
cle that has a bearing at least on section
3.06 of the legislative article.

I will not take the time of the Conven-
tion to go into detail at this particular
time, because Chairman Koss is iToing to
try to work out the problem, and it is a
possibility that it could be resolved. How-
ever, inasmuch as section 3.06 is affected
