what your amendment does is remove the
four-year election law as we have had it?

THE CHAIRMAN: Delegate Raley.

DELEGATE RALEY: No, I do not see
any conflict.

THE CHAIRMAN: Delegate Adkins?

DELEGATE ADKINS: I should like to
ask the sponsor of the amendment if it is
quite clear in his opinion that under the
last sentence it would be possible for the
General Assembly to provide different times
for elections in different sections of the
State. It seems to me this could be read
in the conjunctive, meaning they would
have to establish a consistent rule. I would
like to be assured that that is not the case.

THE CHAIRMAN: Delegate Raley.

DELEGATE RALEY: I was listening to
somebody over here and did not hear you.

THE CHAIRMAN: State your question
again, Delegate Adkins.

DELEGATE ADKINS: My question spe-
cifically is this. Is it your judgment that
under the last sentence of this provision it
would be possible to establish different
times for elections for local elections in
different sections of the State?

THE CHAIRMAN: Delegate Raley.

DELEGATE RALEY: Delegate Adkins,
yes, I think that is possible.

THE CHAIRMAN: Delegate Adkins.

DELEGATE ADKINS: I want to make
quite clear this is the intent. It is then the
intention of the sponsor of the amendment
that a local election in one section of the
State could be held simultaneously with the
statewide election and at a different time
in some other section of the state. In other
words, there is no requirement here or un-
der the local government article which
would require uniformity in this field.

THE CHAIRMAN: Delegate Raley.

DELEGATE RALEY: Yes, I would say
that that is correct.

THE CHAIRMAN: Delegate Boileau.

DELEGATE BOILEAU: I note in the
legislative article there was in fact a defini-
tive statement as to the term of legislators
as four years. In the executive article, in
section 405, there is a statement "A term
of four years, and until someone is quali-
fied to succeed the office of Governor." Does
this not mean the General Assembly could
in fact perpetuate one individual in the

office of governor by not providing for an
election in that year?

TPIE CHAIRMAN: Delegate Raley.

DELEGATE RALEY: I doubt that
could happen.

THE CHAIRMAN: Delegate Weide-
meyer.

DELEGATE WEIDEMEYER: I was
just wondering if this would in any way
interfere with the provisions of the county
charter or charters of municipalities which
provide for elections on days other than the
first Tuesday after the first Monday of
November.

THE CHAIRMAN: Delegate Raley.
DELEGATE RALEY: I would say no.
THE CHAIRMAN: Delegate Henderson.

DELEGATE HENDERSON: Up to this
point, there has been no suggestion from
any source that we change the four-year
cycle of elections for state officials. All the
argument has been as to whether the
counties should have or cities should have
the authority to hold their elections on a
different date.

Now, is it necessary to go as far as you
do in this amendment? You seem to give
to the General Assembly the power to
change the state-wide election.

THE CHAIRMAN: Delegate Raley.

DELEGATE RALEY: Delegate Hender-
son, I do not think so. It says general elec-
tions of state and county officials shall be
held in such year at such times as the
General Asssembly may provide by law. If
you want to tighten it up in some way, I
certainly would accept that. I see the point
you are making.

THE CHAIRMAN: Delegate Gallagher
and Raley, the Chair would like to make
this suggestion.

It seems to me that your amendment
poses many difficulties, and that it needs
clarification and modification.

Delegate Gallagher has indicated to the
Chair that he would intend to offer his
Amendment AU. Was it in the event this
amendment fails?

DELEGATE GALLAGHER: No, sir, in
the event it passes, Mr. Chairman.

THE CHAIRMAN: Then the Chair
would have to rule that Delegate Galla-
ghcr's amendment could be offered only as
