the attention of either the Convention or
the Committee of the Whole what appears
to be an error in Report of the Committee
of the Whole Number 8, dealing with the
action taken by the Committee of the Whole
with respect to the judicial article?

THE CHAIRMAN: This is a matter
that would have to be corrected before the
Convention. Is the error in the Report it-
self, or in the attachment?

DELEGATE MARION: If by attach-
ment you mean the article as amended by
the Committee of the Whole, yes.

THE CHAIRMAN: That is correct.
DELEGATE MARION: In attachment.

THE CHAIRMAN: I would suggest that
you let me know about that sometime dur-
ing this morning and we will make the cor-
rections at the next session of the Conven-
tion.

The first item on the agenda for the
Committee of the Whole is the special
order of business, consideration of Recom-
mendation No. 1 of Committee Report
EB-1. The present posture of that matter
is that the Recommendation has been
amended so that it now reads:

"The Committee recommends that a
Board of Public Works be provided for in
the Constitution. "

The tie vote by which the recommenda-
tion as thus amended failed to be either
approved or disapproved, was reconsidered.
The matter is now in that situation.

The Chair recognizes Delegate Morgan.

DELEGATE MORGAN: Mr. Chairman,
I have an amendment to Committee Recom-
mendation No. 1 of Committee Report EB-1.

THE CHAIRMAN: State the amend-
ment.

DELEGATE MORGAN: The Committee
Recommendation No. EB-1 be amended to
read as follows, and it is at the Clerk's
Desk: "the Committee recommends that a
board of review be provided for in the Con-
stitution. "

THE CHAIRMAN: The amendment,
therefore, would be to strike the words,
"Public Works", in line 14, and insert the
word, "review".

Is the amendment seconded?

DELEGATE MORGAN: Also, to strike
the word "the".

THE CHAIRMAN: That has already
been done.

Is there a second?

(Whereupon, the motion was duly sec-
onded. )

THE CHAIRMAN: Is there any discus-
sion?

Delegate Della?

DELEGATE DELLA: Mr. Chairman,
will Delegate Morgan yield for a question?

THE CHAIRMAN: Delegate Morgan?
DELEGATE MORGAN: I yield.
THE CHAIRMAN: Delegate Della.

DELEGATE DELLA: Delegate Morgan,
I see that you have a three-man board,
known as the board of review, with the
governor and comptroller.

Did your Committee consider naming the
third person or the position of the third
person, whether it be secretary of state or
the director of planning, because you are
leaving in mid-air the third person, that
may be in the administrative interest of
the state government.

THE CHAIRMAN: Delegate Della, the
Chair calls to your attention that the mat-
ter to which you refer is a matter covered
by Amendment No. 10 of Committee Rec-
ommendation EB-1, adopted last evening.
The only purpose of the change in the Com-
mittee Report at this point is to make it
conform to the action taken last night with
respect to the recommendation.

DELEGATE DELLA: Mr. Chairman,
the only purpose in asking Delegate Mor-
gan this question is my belief that it is
proper that the position should be desig-
nated; whether we are considering it now,
I am only mentioning it.

THE CHAIRMAN: That is my point.

We are not considering now the precise
language.

DELEGATE DELLA: That is right.

I am only bringing to his attention and
the Committee's attention that I think for
good legislation, the third position should
be named and not be left in mid-air.

THE CHAIRMAN: Very well.
Delegate Morgan?

DELEGATE MORGAN: Mr. Chairman,
under the Committee's Recommendation of
