be increased nor diminished during the
terms for which they were elected.

THE CHAIRMAN: Is there any further
discussion?

Delegate Morgan.

DELEGATE MORGAN: Mr. Chairman,
if this amendment is adopted, which I as-
sume it will be, I ask unanimous consent
that the heading of section 4. 04 read,
"Salary of governor, lieutenant governor,
comptroller, and attorney general. "

THE CHAIRMAN: The Chair will put
that to the Committee after action on the
amendment.

The Clerk will ring the quorum bell.

The question arises on the adoption of
Amendment — Delegate Sollins.

DELEGATE SOLLINS: Mr. Chairman,
a point of inquiry to the Chairman of the
Committee, please.

THE CHAIRMAN: Delegate Morgan.
State your inquiry.

DELEGATE SOLLINS: As I under-
stand it, we have not as yet resolved the
question of whether the attorney general
shall be elected or appointed and yet this
is inherently assumed in this amendment.
I wonder if it is not premature.

THE CHAIRMAN: Why is it? The
Chair did not follow your inquiry. Why
does the section assume that the attorney
general is elected or appointed?

DELEGATE BOYCE: It has been
elected, sir.

THE CHAIRMAN: I understand. I fol-
low. Delegate Morgan, the question is
whether it is proper to offer this amend-
ment at the present time inasmuch as it
refers in line 24 to election and the Com-
mittee has not yet decided whether the at-
torney general shall be appointed. Dele-
gate Morgan.

DELEGATE MORGAN: Mr. Chairman,
I think after the vote this morning on
Committee Recommendation No. 4 in Re-
port EB-1 it would be fantastic if the at-
torney general were not voted as an elected
official, so I suggest that it would not be
premature to make this change.

THE CHAIRMAN: Are you ready for
the question?

Delegate Sollins.

DELEGATE SOLLINS: Mr. Chairman,
do you concur with what the Chairman of
the Committee has suggested, that we do
not vote on the issue of whether or not the
attorney general should be appointed or
elected, and perhaps what his duties and
powers and responsibilities might be be-
fore we determine that he has a term of
office?

THE CHAIRMAN: I did not understand
that the Chairman of the Committee dif-
fered with that conclusion. I understood
him to say that it was fantastic to believe
that this Committee would not provide for
the election of an attorney general. The
Committee could, of course, decide other-
wise.

I might suggest to Delegate Sollins that
if the unexpected should happen, the mat-
ter would still be before the Committee and
could easily be corrected.

Are you ready for the question?
(Call for the question. )

The Clerk will ring the quorum bell. The
question arises on the adoption of Amend-
ment No. 9. A vote Aye is a vote in favor
of the amendment. A vote No is a vote
against.

Has every delegate voted? Does any dele-
gate desire to change his vote?

(There was no response. )
The Clerk will record the vote.

There being 112 votes in the affirmative
and 2 in the negative, the motion is carried.
The amendment is adopted.

Delegate Morgan.

DELEGATE MORGAN: Mr. Chairman,
I ask unanimous consent that the heading
of section 4. 04 read as follows: "Salary of
governor, lieutenant governor, comptroller,
and attorney general. "

THE CHAIRMAN: Is there any objec-
tion to changing the caption of section 4. 04
so that it reads, "Salary of governor, lieu-
tenant governor, comptroller and attorney
general"?

(There was no response. )

The Chair hears no objection. The cor-
rection will be made.
