1432 CONSTITUTIONAL CONVENTION OF MARYLAND [Nov. 29]

THE CHAIRMAN: Let me go back lest
we forget one that has been passed over
quite a few times. Delegate Chabot's long waited amendment to section 4. 03 is now
available. Will the pages please distribute
Amendment AQ.

DELEGATE RYBCZYNSKI: Mr. Chair-
man.

THE CHAIRMAN: Delegate Rybczynski.

DELEGATE RYBCZYNSKI: Mr. Chair-
man, I believe there was the promise
earlier that we would consider three
amendments together. The third would
have to do with the newly named Board of
Public Works. I think most of us would
like to get that one over also.

THE CHAIRMAN: The Chair had un-
derstood that amendment was not printed,
Delegate Rybczynski. Is this correct, Dele-
gate Morgan?

DELEGATE MORGAN: Mr. Chairman,
that is the amendment that I intend to
offer.

THE CHAIRMAN: I am sorry.

DELEGATE MORGAN: I have it before
me here.

THE CHAIRMAN: Well then withhold
this. Continue distributing Amendment AQ
but do not make it as yet. Is the other
amendment printed?

DELEGATE MORGAN: Mr. Chairman,
the other amendment is designated, AS.

The pages will distribute Amendment
AS.

THE CHAIRMAN: Amendment AS now
being distributed will be Amendment No.
10. Have the pages distributed this amend-
ment? Will you please state your amend-
ment and let me call your attention to
some changes which the sponsor has made
in lines 1, 2, 4 and 7. Lines 1 and 2 will
read as follows: "On page 6 following line
23 add this section". In line 4, strike out
the word, "interdepartmental. " In line 7,
strike out the word, "an interdepartmental, "
and insert the word, "a". Delegate Morgan.

DELEGATE MORGAN: In line 1 it
should be, following line 27, instead of line
23.

THE CHAIRMAN: I thought I had
said that. The first two lines will read, "on
page 6 following line 27 add this new sec-
tion"; is that correct, Delegate Morgan?

DELEGATE MORGAN: That is correct,
Mr. Chairman.

THE CHAIRMAN: The Clerk will read
the amendment.

READING CLERK: Amendment No. 10
to Committee Recommendation EB-1 by
Delegate Morgan: On page 6 following
line 27 add this new section: Section
Board of Review.

There shall be in the executive branch of
the government a board of review which
shall consist of the governor, an officer in
the executive branch designated by the
governor, and the comptroller. The board
shall perform in such manner and have
such powers as the General Assembly may
prescribe, including but not limited to the
following:

1) the creation of state debt,

2) expenditures from the proceeds of
such debt,

3) expenditures for the acquisition of
land or the construction of buildings, equip-
ment, or other public works,

4) the transfer or disposal of state
property or rights,

5) expenditures from lump sum appro-
priations not detailed by law,

6) expenditures from the General Emer-
gency Fund of the State, and

7) the establishment from time to time
of the state property tax rate.

THE CHAIRMAN: Is the amendment
seconded?

(The amendment was seconded. )

THE CHAIRMAN: The amendment hav-
ing been seconded, the Chair recognizes
Delegate Morgan to speak to the amend-
ment.

DELEGATE MORGAN: Mr. Chairman,
this is the amendment agreed to as a com-
promise by the Committee on the Execu-
tive Branch yesterday. It sets up a board
of review in lieu of a Board of Public
Works, consisting of the governor, an officer
of the executive branch designated by the
governor and the comptroller.

The Board is to have such of the exist-
ing functions of the Board of Public Works
as the legislature may prescribe and can
also have other functions prescribed by the
General Assembly.

It is hoped that in prescribing the func-
tions of the board of review, the General
Assembly will winnow out from those func-
tions all of the trivia which now clutter up
