said Elizabeth Atkinson, deceased, or their order.

    Mr. J. Thomas and Mr. Wilkins have leave of absence.
    The bill to lay out and open a public road in the upper part of Queen-Anne's county, was
read the second time by especial order, and passed.
    On motion, ORDERED, That the report of the committee of finances have a second reading
on to-morrow.
    Mr. Greenwell, from the committee, delivers to the speaker the following report:
    THE committee to whom was referred the petition of Arthur Thompson, and Anne Thompson
his wife, of Saint-Mary's county, have taken the same into consideration, and beg leave to report
the following facts:  That captain Nicholas Manger devised the whole of his estate, after
the death of his wife, to his two daughters in law, Rosanna Thompson and Anne Carbury; that
Rosanna Thompson died without will, or leaving issue; that Anne Carbury is married to Arthur
Thompson.  Your committee further beg leave to state, that captain Manger was entitled to
four lots of land lying in Allegany county, for his services as an officer in the late revolutionary
war, but that the last will and testament of the said captain Manger, disposing of his estate as
aforesaid, was only attested by two witnesses.  Your committee are of opinion, that inasmuch
as the said captain Manger died without leaving any relations within the United States, and as
the petitioners have obtained from the land-office of the western shore and escheat warrant for the
same, your committee think it reasonable that the state should relinquish to the petitioners the
caution money that will arise from obtaining the said warrant; therefore submit to the house the
following resolution:
    RESOLVED, That the state release its interest to the composition or valuation of the land escheated
by Arthur Thompson, and Anne Thompson, his wife, of Saint-Mary's county, and
the register of the land-office of the western shore is hereby directed to issue patent on the land
included in said escheat warrant, with an estate to Arthur Thompson for life, remainder to Anne
Thompson, her heirs and assigns, saving all rights heretofore acquired by any person to or in
said land, or in any part thereof.

    The report on the petition of John Ryan was read the second time, and the resolution therein
contained assented to.
    Mr. Digges, from the committee, delivers to the speaker the following message:

By the HOUSE of DELEGATES, December 27, 1799.
        GENTLEMEN OF THE SENATE,
    WE wish not to protract the session by any unnecessary delay, but the private and public business
now on the table cannot, in our opinion, be acted on with justice to our constituents so as to
close at the day proposed by you; our exertions shall not be wanting to accomplish the business as
early as possible, which we flatter ourselves may be effected by Saturday the fourth of January,
but we fear not sooner.

Which was read the first and second time and agreed to.
    Mr. Duckett, from the committee, delivers to the speaker the following report:
    THE committee to whom was referred the petition of James Frazier, of Prince-George's
county, report, that they have taken the same into consideration, and are of opinion that the
state ought to pay to the said James Frazier the amount of sales of his property, which has been
improperly confiscated; they therefore submit the following resolution:
    Whereas one hundred acres of land, lying in Prince-George's county, were sold by the agent
of the state to a certain James H. Smith of said county, as the property of James Frazier, and
liable to confiscation:  And whereas it appears that the said property was improperly sold, the
said James Frazier being attached to the interest of this state, during the late revolution, RESOLVED,
That the treasurer of the western shore pay to the said James Frazier, or his order, the
amount of the sum for which the property was sold as aforesaid.

Which was read.
    Mr. Hall, from the committee, delivers to the speaker the following report:
    THE committee to whom was referred the petition of Elizabeth Presley, of the city of Annapolis,
report, that they have taken the same into consideration, and are of opinion the facts
therein set forth are true, and the prayer of the petitioner appearing reasonable, ought to be
granted; they therefore submit the propriety of the following resolution:
    RESOLVED, That the auditor be and he is hereby authorised and directed to audit and settle
the claim of Mary Anne Elizabeth Presley against this state, and that the treasurer of the western
shore (when the said claim is so adjusted and ascertained,) pay over to Mary Presley, or her order,
the sum that may appear to be so due.

    Mr. Brome, from the committee, delivers to the speaker the following report:
    THE committee to whom was referred the petition of Anne Gross, report, that from the certificates
