A petition from the trustees of Lower-Marlborough
academy, and others, praying the surplus
funds of Saint-John's college may be applied tot he said academy, was preferred,
read, and referred
to Mr. Taney, Mr. Key, Mr. Brome, Mr. Carcaud and Mr. Franklin, to consider
and report
thereon.
Mr. Ayres, from the committee, delivers to the speaker
a bill, entitled, An act to empower
the justices of the levy court of Harford county to assess and levy a sum
of money for the purpose
therein mentioned; which was read the first time and ordered to lie on
the table.
The bill respecting a partition of the estate of John
Davidson, deceased, was read the second
time, passed, and sent to the senate by the clerk.
Mr. Carroll, from the committee, delivers to the speaker
the following report:
THE committee appointed to inquire what laws expire
with the present session of assembly,
beg leave to report on the following, viz:
No. 1. An act to oblige infected ships and other
vessels coming into this province to perform
quarantine. November, 1766, ch. 25.
2. A supplementary act to the act, entitled, An
act ascertaining the height of fences, to prevent
the evil occasioned by the multitude of horses, and restraining horse-rangers
within this province,
and to redress the great evil accruing to this province by the multiplicity
of useless horses,

3. An act for regulating the gauging of casks

Which was read.
Mr. Leigh, from the committee, delivers to the speaker
a bill, entitled, An act to repair the
public gaol in Saint-Mary's county; which was read the first and second
time by especial order,
passed, and sent to the senate by the clerk.
Mr. Carroll, from the committee, delivers to the speaker
a bill, entitled, An act to declare
certain roads in Baltimore county public highways; which was read the first
and second time by
especial order, passed, and sent to the senate by the clerk.
Mr. Magruder, from the committee, delivers to the speaker
a bill, entitled, An act to lay out
and open a road through part of Montgomery county; which was read the first
time and ordered
to lie on the table.
Mr. Buchanan, from the committee, delivers to the speaker
the following report:
THE committee to whom was referred the petition of Edward
Norwood, of Baltimore county,
report, that they have examined into the facts stated in said petition,
and find them substantiated
by the most satisfactory evidence: the committee recommend to the house
the propriety of
granting relief to the petitioner, and submit to their adoption the following
resolution, to wit:
RESOLVED, That a survey of the land mentioned in the
petition of Edward Norwood to the
present general assembly, and heretofore sold by the intendant of the revenue
to said Edward
Norwood, as the confiscated property of a certain Edward Cooke, for eight
hundred acres, in
the barrens of Baltimore county, be made at the expence of the state, and
under the direction of
the attorney-general; and that the treasurer of the western shore, if he,
on a correct copy of
said survey being exhibited to him, signed and certified by the said attorney-general,
shall be of
opinion that as many acres are not contained in said tract of land
as are contracted to be sold by
the said intendant to the said Edward Norwood, then and in that case the
said treasurer is hereby
authorised and required to accept of such sum of money in payment of the
bond given by said
Edward Norwood to the state for the said tract of land by the survey herein
provided to be
made, and in proportion to the sum stipulated to be paid by said bond,
and that until the said survey
is made, all process heretofore had on the said bond against the said Edward
Norwood, or his
securities, shall cease, and no other process shall be commenced.
