JOHN WALTER SMITH, ESQ., GOVERNOR,
his oath or affirmation, of all fines, forfeitures and penalties
imposed by him under the laws of this State, or under any
ordinances of any incorporated towns of Easton District,
which said account shall show the names of the parties, the
fines and penalties imposed, together with the amount of
costs,, and to whom the said costs were due; and the said
police justice shall, at the time of filing said account, pay
over to the said County Commissioners the amount of all
fines, penalties, forfeitures, justices and State's witnesses'
costs so received by him, to be appropriated by said County
Commissioners as hereinafter provided. Any failure to file
said account, as above required, shall be cause for removal by
the Governor, and the selection of another justice of the
peace to act as police justice in his place. And the Clerk
to the County Commissioners shall immediately notify the
Governor of the failure of the said police justice to file
said account by the time prescribed in this Act, and if said
police justice shall fail to pay over to said County Commis-
sioners all of said fines, penalties, forfeitures and costs col-
lected by him at the time of or before the filing of said
account, he shall be deemed a defaulter, and shall be pro-
ceeded against and punished in the manner prescribed by
Article 27, Section forty-seven, of the Code of Public Gen-
eral Laws, relating to "Defaulters;" provided, that all the
provisions of this Act relating to the quarterly returns to be
made by said police justice, and all the penalties and forfeit-
ures imposed on said police justices for failure to perform the
duties imposed upon him by this Act, or by any other law of
the State of Maryland, shall be applicable to all other justices
of the peace having criminal jurisdiction in Talbot County.

117G. That the fines, penalties and forfeitures of every kind
and for any and every offense, and the costs that would be due
the police justice, under the heretofore existing laws of this
State, and which may hereafter be imposed by the police jus-
tice herein created, shall be paid over to the County Com-
missioners of Talbot County, and shall be kept by the County
Commissioners as a separate fund, and an account of such
fund shall be opened and kept on the books of said Commis-
sioners, and the said Commissioners shall use said fund to pay
the salary of said police justice, in so far as the same may be
sufficient; and if in any year it shall be more than sufficient
for payment of said salary, then the balance remaining of the
said fund shall be appropriated to the payment of constable
fees against the said Commissioners for service of criminal
process before the said police justice.
