CHAPTER 423.
AN ACT to add new sections to Article 2 of the Code of
Public Local Laws, title "Anne Arundel County," sub-title
"County Commissioners," to be designated Sections 1266,
126C and 126D, authorizing the County Commissioners to
have witnesses summoned to testify before them.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That additional sections be added to Article 2 of the
Code of Public Local Laws, title "Anne Arundel County,"
sub-title "County Commissioners," to be designated Sections
126B, 126C and 126D, and to read as follows:

Sec. 126B. Authority is vested in the County Commis-
sioners whenever, in their discretion, the public interests
require them so to do, to issue summons for witnesses to tes-
tify before them as to any matters relating to the opening,
closing, altering or repairing public roads, building or repair-
ing hedges and as to any claims or demands presented against
the county or appropriation asked for; such summons to be
issued by the Clerk to the County Commissioners on their
order and directed to the sheriff of the county, who is author-
ized and required to serve such process in like manner as if

the same issued from a court of law, and he shall be allowed
the usual fees for such service as are allowed by law; witnesses
summoned and testifying before the County Commissioners
may be allowed a fee not' exceeding the per diem now allowed
witnesses in equity cases, but no allowance shall be made to
a witness attending who is brought under an attachment.

126C. When any person is summoned to testify before the
County Commissioners and shall refuse or neglect to obey
said summons the County Commissioners may immediately
certify such default under the hand of their clerk and seal of
their office to the Clerk of the Circuit Court, who shall forth-
with issue an attachment directed to the sheriff against the
person named, compelling such witness to attend and testify
before the County Commissioners, returnable on such day as
may be named in said certificate, which process shall be
allowed to issue by the Circuit Court for Anne Arundel County.

Sec. 126D. Authority is hereby vested in the County Com-
missioners to take the testimony of any witness before
them, whether summoned or otherwise, under oath, to be
administered by the president of the board, or in his absence
by one other of the Commissioners, who are authorized to
