Mayor and
Council
authorized to
provide for
the collection
and removal
of garbage

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Mayor and Council of Hagerstown are hereby
authorized and empowered to establish by ordinance a system
for the collection of garbage within the corporate limits of
Hagerstown, and its removal beyond said limits, together with
the disposal of the same when so collected or removed, and
to this end are authorized and empowered to enter into con-
tract with any person or persons, corporation or corporations,
for the performance of any duty or services made necessary
or proper by such ordinance, or in their discretion the said
Mayor and Council may appoint officers and agents to per-
form such duty or services, to be appointed as other city
officers are appointed; provided, that no contract made under
the provisions of this section shall be longer than five years.
And the said Mayor and Council are authorized and empowered
to fix rates to be paid, either to the Mayor and Council, or
the person or persons, corporation or corporations contracting
with said Mayor and Council by the citizens creating or pro-
ducing garbage, for the collection and removal of the same.
And the said Mayor and Council are authorized and empow-
ered to provide for the collection of said rates by use of the
same processes as the tax collector of Hagerstown may employ
for the collection of taxes, or by an action of debt, or by fine
within the limits that the power to fine is now exercised by

the said Mayor and Council in the enforcement of the ordi-
nances of the Mayor and Council of Hagerstown, and the
said Mayor and Council are hereby authorized and empowered
to levy taxes in addition to the amount now authorized by law
sufficient to meet the necessary expenses incurred to carry
out the provisions of this section; provided, the said addi-
tional tax does not exceed three cents on the hundred dollars
at the annual levy.

ard a sum of money erroneously paid as taxes.
