116. Any person who shall violate the provision of Section
115 shall be guilty of a misdemeanor, and on conviction
thereof before any court or justice of the peace having juris-
diction shall be fined twenty-five dollars, one-half of which
shall be paid to the informer and one- half to the deputy game
warden of the county, and costs, and stand committed to the
county jail until fine and costs are paid, and shall also forfeit his
weirs, nets and appliances, which shall be sold at public sale
by the constable or other officer making the arrest, and the
proceeds of said sale, after deducting costs of sale, shall be
paid to the County Commissioners of the county for the use
of the public schools of said county.

Penalty for
violation of
Section 115.

SEC. 2. And be it enacted, That this Act shall not be con-
strued so as to affect any prosecution for violation of this
Article, or any section thereof, for offenses committed prior
to the passage of this Act, and all Acts and parts of Acts
inconsistent with this Act are hereby repealed.

SEC. 3. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 697.
AN ACT to repeal and re-enact, with amendments, Article 9,
Section forty-six, of the Code of Public General Laws, title
"Attachments," sub-title "Claimant of Property."

Offenses prior
to passage of
this Act.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section forty-six of Article 9 of the Code of Public
General Laws, title "Attachments," sub-title "Claimant of
Property," be and the same is hereby repealed and re-enacted,
so as to read as follows:

Claimant of
property.

46. Upon the filing of a bond by or on behalf of such claim-
ant, in a penalty equal to double the value of the property, as
ascertained by an appraisement thereof, to be made by the
Sheriff at the time of the levy, to be approved of by the clerk,
and conditioned for satisfying all costs and such damages, not
exceeding the real value of the property attached, as the
plaintiff shall recover. In case said claimant shall fail to es-
tablish his claim the said property shall be discharged from
the levy and surrendered to such claimant.
