street, lane, alley or footway is to be opened, altered, closed
or established; and the said examiners shall, before proceeding
to act as such, take an oath, to be administered to them by
some justice of the peace of Allegany County, that they will
diligently and faithfully, to the best of their judgment, dis-
charge the duties of their office without favor, partiality or
prejudice, and a copy of said oath, subscribed to by said

examiners, shall be made a part of their report to said Com-
missioners; and the said examiners shall proceed in all respects
in the same manner as is provided by the Code of Public
General Laws now in force in regard to the opening, altering
and closing of roads, so far as the same may be applicable,
excepting that the return and report of said examiners shall
be made to and ratified or rejected by the Commissioners of
said town, instead of the Board of County Commissioners for
said county; and in case said Commissioners of Midland shall
order the return made by said examiners, or a majority of
them, to be ratified and confirmed, the said Commissioners of
Midland shall pay the said damage to the respective parties,
or their executors, or administrators, or their guardians,
agents or attorneys, before the said street, road, lane or alley
shall be opened, altered, closed or established; and any
person aggrieved by said decision may at any time within

How payment
provided.

sixty days, appeal to the Circuit Court for Allegany County,
which shall hear and determine the same as in appeals from
County Commissioners; to grade, gravel, pave or macademize
any of the streets, roads, lanes or alleys in said town, and to
regrade, repave or repair the same, and the entire expense of
paving and repaving any of the streets, lanes and alleys of said
town shall be paid out of the general treasury, and be provided
for in the general levy of said town, and shall not be specially
assessed upon the owners of property abutting thereon, and
also to grade, regrade, gravel, pave, kerb or repair any of the
footways in the said town, and shall assess the whole cost of
said work pro rata upon the owners of the property binding
thereon, and for collecting such assessments, as other taxes

voters, etc.

are collected under this charter; and such assessments shall
be a lien upon the property chargeable therewith; to pro-
vide for the introduction of water, electric light or gas into
said town; to provide for the registration of voters in said
town, and the manner of holding elections therein; and to
adopt and enforce all proper police regulations for the gov-
ernment of public meetings or large assemblages of any kind;
to impose a tax or license on itinerant medicine venders, and
generally to pass all such by-laws, resolutions and ordinances
as may be proper and necessary to carry into effect the true
