the same as are herein allowed constables in the other
districts, but shall be collected, paid to arid accounted for
by justices of the peace as prescribed in the preceding
sections; and no warrant shall be issued by the justices
of the peace to either constables of the districts 3, 17, 21,
22, 24 and 25, or the the sheriff of said county on the
oath or affirmation of another constable or other officer,
and no warrant shall be issued by said justice to a con-
stable or to the sheriff on the oath or affirmation of any
police officer of the town of Hagerstown; and when any
warrant is issued by a justice of the peace on the com-
plaint, oath or affirmation of any constable, sheriff, deputy
sheriff or other officer, and such charge shall be dismissed
or the defendant acquitted, no fees in such cases shall be
allowed by the county commissioners to any officer serv-
ing such warrant or other process.
"265 I. The constables of the 3, 17, 21, 22, 24 and 25
districts of said county for the service of all process and
summonses for witnesses made by them in criminal cases,
shall receive from the county commissioners the sum of
$35. 00 per month, payable in cash or county order equiva-
lent to cash on the day of his making his report which
he is required to submit in writing, under oath taken be-
fore the Clerk of the Circuit Court for Washington county,
to the county commissioners at their first regular meet-
ing in each month said report shall contain in detail each
and every charge he may have against the county; provided
that if the, amount of the constables' fees for the service
of process by him. as may appear by his report and the
report of the justices of the peace is less than $35, then
and in that case such constable shall only receive the
amount of fees appearing by said reports to have been
earned by him.
"265 J. The duly appointed and qualified police officers
of the town of Hagerstown are hereby invested with full
power and authority of county constables without pay
other than that received from said town, but they shall
not have any jurisdiction in civil cases.
"271. The justices of the peace in Washington county
except the justices of the 3, 17, 21, 22. 24 and 25 dis-
tricts, shall be entitled to charge for their services in
all criminal cases tried or heard before them the fol-
