Preamble.
Title vested,
&c. |
An ACT for the relief
of John Woodall, of Kent county.
WHEREAS a certain Thomas Barry, late of Kent county, deceased, did
heretofore, to wit,
on the eighth day of April, seventeen hundred and ninety-five, convey to
Bodean Warner
part of three tracts of land, called Smother's Part of Addition, Rumford
Resurveyed, and Vyanna,
lying and being in Kent county, containing one acre of land: And
whereas the said Thomas Barry
acquired a title to the aforesaid land after his emigration to, and settlement
in, this state, and before
his naturalization agreeably to law, whereby the title of the said Thomas
Barry to the aforesaid
lands, at the time of the conveyance aforesaid, has become doubtful:
And whereas the said Bodean
Warner, did, on the thirteenth day of August, seventeen hundred and ninety-nine,
convey the aforesaid
lands to John Woodall, of Kent county; therefore,
II. BE IT ENACTED, by the General Assembly
of Maryland, That the title to the aforesaid lands be
and the same is hereby as amply and fully vested in the aforesaid John
Woodall, as if the said
Thomas Barry had been naturalized before his title to the said lands had
been acquired; provided
always, that nothing in this act contained shall be construed in any manner
to affect any right, title
or claim, to the aforesaid lands, or any part thereof, acquired or prosecuted
by any person or persons
before the passage of this act. |

CHAP. XLVIII.

Swine not to
go at large, &c.
General issue
pleadable. |
An ACT to prevent swine from going at large in the town of Queen-Anne,
in Prince-George's county.
BE IT ENACTED, by the General Assembly of Maryland, That from
and after the first day of April
next, no swine belonging to the inhabitants of the town of Queen-Anne,
or the inhabitants of
Prince-George's county living within one quarter of a mile of said town,
shall be suffered to go and
remain at large in said town, or within a quarter of a mile of the said
town, in the said county as
aforesaid; and if any swine belonging to the inhabitants as aforesaid,
shall be found going and remaining
at large within the said town, or within one quarter of a mile of said
town, in said county,
it shall and may be lawful for any person or persons to kill or impound
the same, and if impounded,
such person or persons shall immediately give notice, by advertisements
set up at the most public
places in the said town, describing the swine so impounded, and if the
owner or owners shall not,
within five days after the setting up said advertisements, prove his or
her property therein, and
make compensation for the injury, (if any,) which may have been sustained
by any inhabitant of
said town or county as aforesaid, to be ascertained by any two disinterested
persons, inhabitants as
aforesaid, and shall not pay for every such swine the sum of twenty-five
cents for every day it shall
have been impounded, it shall and may be lawful for the person or persons
impounding as aforesaid,
to sell, or kill the same for his or her benefit.
II. AND BE IT ENACTED, That if any person or
persons shall be sued and impleaded for killing,
destroying or selling, any such swine as aforesaid, the defendant or
defendants may plead the general
issue, and give this act and the special matter in evidence; provided that
nothing in this act contained
shall be construed to extend to Anne-Arundel county. |

CHAP. XLIX.

Geese, &c. not
to go at large,
&c.
General issue

An ACT to prevent the going at large of geese and swine in Creager's-town,
Frederick county.
BE IT ENACTED, by the General Assembly of Maryland, That from
and after the first day of April,
in the year of our Lord one thousand eight hundred and one, no geese or
swine belonging to
the inhabitants of said town shall be suffered to go at large in Creager's-town
aforesaid, it shall
and may be lawful for such person to kill, or cause to be killed, such
geese or swine.
II. AND BE IT ENACTED, That if any person shall
be sued for killing any swine or geese going at
large in Creager's-town aforesaid, such person may plead the general issue,
and give this act and the
special matter in evidence. |
