1800.
CHAP. L.
    An ACT for the relief of Henry Disherd, of Frederick county.
WHEREAS Henry Disherd, of Frederick county, has emigrated to, and settled in, this state,
and since his emigration to, and settlement in, this state, hath acquired real property therein,
and his title to such property, from his not having been naturalized before such property was
acquired by him, may be called in question, to his great injury and detriment;

    II.  BE IT ENACTED, by the General Assembly of Maryland, That the title to all the real property,
lawfully and fairly acquired by the said Henry Disherd, whether such title be derived by grant, gift,
purchase of devise, be and the same is hereby as amply and as fully vested in the said Henry Disherd,
to all intents and purposes, as if he had been naturalized before his title to such property had been
acquired; saving nevertheless to all persons who may have acquired, under the present existing laws
of this state, a title to any part of the real estate held by the said Henry Disherd, or any person or
persons claiming under him, their several and respective rights; and provided also, that unless the
said Henry Disherd shall, on or before the first day of June next, proceed according to law to make
himself a citizen of the United States, this act shall have no effect to confirm his title to the real
property by him heretofore acquired, nor shall he, or any person claiming under him, derive any
benefit under this act; but if the said Henry Disherd shall die before the time when, by the laws of
the United States, he may become a citizen thereof, nothing in this proviso contained shall prevent
him from transmitting or transferring his said property by descent or devise to any issue he may leave
residing within the United States, who is hereby declared capable in law to hold the same, or to
any other person, being a citizen of the United States, and capable in law to hold the same.

CHAP. LI.
A Supplement to an act, entitled, An act to authorise and empower
    the levy court of Montgomery county to assess and levy a sum of
    money on the assessable property thereof for the purpose of building
    a new gaol in said county.

WHEREAS by the act to which this is a supplement, the levy court of Montgomery county
was authorised and directed to assess and levy on the assessable property in said county a sum
of money, not exceeding twelve hundred pounds, for the purpose of building the gaol aforesaid,
which sum has been levied and collected:  And whereas the commissioners appointed by said act did
contract for and let the building of said gaol to a certain Charles Beckwith, and did advance to the
said Beckwith the sum of one hundred and sixty pounds, for the purpose of procuring materials doe
the said gaol; that soon after the said Beckwith departed this life:  And whereas by an act passed
the last session of assembly, the heirs, executors and administrators, and also the securities, of the
said Charles Beckwith, were to be released and exonerated from all contracts entered into by the
said Beckwith with the commissioners aforesaid, in any manner respecting the said gaol, upon the
express condition, that the money so as aforesaid advanced to the said Beckwith should be returned
to the commissioners aforesaid on or before the first day of March last, with interest thereon from the
time the said advance took place, which condition was not complied with:  And whereas the said
commissioners did not think themselves authorised to contract with any other person for the building
the gaol aforesaid, in as much as the provision aforesaid was not complied with, by reason of which
the county suffers great inconvenience; therefore,

    II.  BE IT ENACTED, by the General Assembly of Maryland, That the commissioners aforesaid be and
they are hereby authorised and directed to execute, without delay, the several duties required of
them by the act to which this is a supplement, in as full and ample manner as if the contract aforesaid
had never taken place.

    III.  AND BE IT ENACTED, That the time limitted for the return of the money so as aforesaid advanced,
be and the same is hereby extended to the first day of June next, and if the said sum of money,
together with the interest that may accrue, be not paid to the said commissioners, or to such
person or persons as they, or a majority of them, may appoint to receive the same, on or before the
said first day of June, that then the said commissioners, or a majority of them, are hereby authorised
and directed to sue for and recover the same.
