The peticon of Robert Downe shewing how that Margarett Morris late of this County deced Stood
indebted to your peticoner in the Sume of four hundred and forty pounds of porke for goods delivered
as appears pr Accot: for which said debt your peticoner humbly craves an order for, against Thomas
Gordon admr: to the estate of the said deceds
Margarett Morris deced Dr lb porke
To 44 yds: Kiersy at 40lb pork pr yd: 160 Came Robert Downe & in open Court made Oath
To 3 Ells Dowlish at 40 pr yd: . . . 120 Upon the holly Evangelist that this Accot: is a true &
To 1 paire of Shoose at . . . 20 just accot: & that he never reced noe part nor parcell
To 1 broadcloath wastcoate at . . . 70 Thereof - - - - - - - - -
To 1 pc bodies at - - - - - 70

Upon which it was ordered that Thomas Gordon admr: as aforesaid pay unto the said Robert
Downe out of the estate of the said Jenckin Morris & Margarett his wife deced the sume of ffour
hundred & fforty pounds of porke &ca: - - - - - - - - - - -

Capt: William Whittington plt: Sumrsett County Ss John Swain of this County was attached to
Agt: Answer unto Capt: William Whittington & Attalanta Osborne
John Swain plt: Admrs: of all & Singular the goods Chattles & Creditts of John
Osborne late of this County deced in a plea of Trespass &a:
And whereupon the plts: by their Attournyes John Taylor comes & Sayes that the deft:
became indebted unto the said plts: upon the Tenth day of May in the yeare of our Lord God
One thousand six hundred eighty & four as p a bill here in Court read is to produce wherein //
The said deft: did Oblidge himselfe his hiers executors: & admrs: to Sawe a good Sufficient frame
for a house of forty foot long over getted of each Side one foot without the plates the house
below the plates Twenty foot wide the Stoods & rafters three & four foot inches thick //
in the flatt sides of them the Studdes eight foot longe Rafters eighteen foot & halfe Longe
the Couplings for every rafter Nine foot long three & four inches thick on the flatt sides with
with braces of convenient length & thickness plates forty foot long Six & Seaven inches on the
flatt sides the joise to be five & Six inches on the flatt sides the ground sells Six & Seaven
Inches likewise & falce plates for each side four & five inches on the flatt sides for which
Worke I owne to have reced four bushells of wheate & the rest Secured to be paid in a parcell of
Land this worke I doe ingadge to finish by the last day of October next ensueing the date ~
hereof the said Swain to find himself meate drinke & all Manner of Trade or Labour there
=to at his owne cost & deliver the said frame compleate for such a house tho not menconed
in every particullar & deliver the same unto John Osborne his heirs or assignes on the
aforesaid last day of October at the Saw pitt on Some part of the land Called Conveniency
belonging to John Osborne for the true performance whereof I binde my selfe my heirs executors:
firmly by these presents but the said John Swain little regarding his promise or assumption
but fraudulently intending the plt: to deceive the Same worke doth Utterly refuse to doe tho
often thereunto required by the plt: to the greate loss & damage to the vallew of Twenty
Thousand pounds of Tobacco & thereupon brings his Suite - &a:
The Contents of the bill as in the above declaracon Specified vs supr &ca: - - - - -
Thomas Selby & Matthew Scarbrough Sworne &Sumoned pr order of Court - - - -
And the said John Swain by Thomas Poole his Attourney Cometh & defendeth the force
& injury when &a: & prayeth liberty to imparle hereunto untill the next County Court & it is
granted to him the same day is granted to the plt: alsoe -
At which said County Court (to witt) the 14th: day of November in the xiiith: yeare of the
Domion of the Rt: honlble: Charles &a: annog Domi 1688 Came the said parties by their Attournies
aforesaid & the said John Saith that the said Whittington his accon he ought to have
