The 14th: day of November 1688 Comrs: as aforesaid 91
Came James Inglish & John Renshaw & in open Court made Oath upon the holly Evangelist to the
best of their knowledge on the behalfe of the Rt: honoble: the Lord propry: against Augustine Standford
for hog stealing &ca: - - -
Richard Whitty plt:
agt: Sumrsett County Ss John Poole of this Courty was Sumoned to answer
John Poole deft: unto Richard Whitty of a plea of Trespass &a: - - - - -
// And Whereupon the said Richard Whitty by Edmund Beauchamp his Attourny Saith
That in or about the mounth of May last past this present yeare Annog Domi 1688 the deft: John
Poole illegally tooke up a certaine gielding of the plaintiffs & him did ride without the Leave and
Consent of the plt: the said Gelding being not returned to the plt: the plt: Saith he is damnified
for want of the said Gielding to the vallew of 1600lb: of Tobao: & thereupon brings his Suite --
And the said John Poole by his Attourney John Taylor cometh & defendeth the force &
Injury when &a: & Saith that the plt: his accon he ought not to have for that he did never ride -
Any horse of the plt: as in Manner & forme declared neither did he see any brand marke of
Richard Whitties & therefore puts the plt: to the proofe of his Declaracon &ca:
Upon which Came both parties by their Attournyes aforesaid & by mutuall consent put themselves
To the judgment of this Court
Whereupon it is this day to witt the 14th: day of November as aforesaid Considered by this Court
that the said Richard Whitty recover against the said John Poole the Sume of Six hundred
pounds of Tobacco debt recovered as alsoe the sume of pounds of Tobaq:
Cost of Suite & the deft: in Mercy &t: - - - -
The peticon of William Piper read Shewing that the late Margarett Morris deced had of your peticonr
had of Necessaries for her husbands burying and likewise others for the said Margaretts buriall to the vallue
of Two hundred Ninety & Nine pounds of porke as pr accot: appeares your peticoner humbly begs your
Worships order for the said debt out of the said Jenckin Morris is estate &tr-
The estate of Jenckin Morris Dr: lb porke pr Contra Credts
To 500 kivering Nailes at lent him by porke overpaid in the last accot: . . . 06=
To 42 foot of planck & 100 XXd nails 050 Due to ball: to Capt: Wm: Piper . . . . 299
To a winding Sheete being 4 yds of Linin at 100 = 305 =
To Nailes for Margaretts Coffin . . . . 15
To a bushell of wheate at . . . . . . . 32 Then came the aforesaid William Piper & in open
To 4 ½ galss: Mollasses at severall times . 90 Court made oath upon the holly Evangelist to this accot
To galloon binding & buttons . . . . . . 18 to be a true & just Accot: & that he recd noe part

Whereupon it was this day to witt the 14th: day of November as aforesaid Ordered that Thomas
Gordon as admr: of the goods Chattles & Creditts of Mo Jenckin Morris & Margarett his wife late of
this County deced pay unto Capt: William Piper of this County out of the estate of the said Deceds the
Sume of Two hundred Ninety & Nyne pounds of porke &ca: - - - - - - -

The peticon of Stephen Coston of this County desireing his fyne might be remitted but would not be
granted for this time &a: - -
The peticon of William Elgate of this County shewing that Margarett Morris the wife of Jenckin
Morris late of this County deced is indebted to your peticoner in the just Sume of Two hundred pounds
of porke for five gallons of Rum at fforty pounds of porke pr gallon which the said Margarett had of
your peticoner for which your said peticoner craves an Order for the same out of the estate of the said deceds
Came William Elgate & sweare in open Court upon the holly Evangelist that the said sume is his just debt
and due to him & that he never reced noe part nor parcell thereof
Upon which it was ordered that Thomas Gordon as admr: of the estate of the said Jenckin Morris &
Margarett his wife deced pay the aforesaid Sume of Two hundred pounds of porke out of the estate of
the said deceds unto William Elgate aforesaid &ca: - - - - - - - - -
