Charles Tendall pl^t: Sum^rsett County Ss Robuck Lynch late of this County
Ag^t: was Attached to answer unto Charles Tendall in a
Robuck Lynch def^t: plea that he render Six pounds eighteen Shillings Sterl.
in a plea that he render him Mony which he oweth & unjustly detaineth &c^a: - -
15^Ł: 4^S: Sterl.
And whereupon the pl^t: by Thomas Poole his Attourney Comes & Sayes
That the def^t: upon the Twenty Second day of November in the yeare of our Lord god
1687 became indebted unto the pl^t: in the full & just Sume of Six pound Eighteen
Shillings Sterling money as will in Court more plainly appeare by a Certaine Writeing
under the hand of him the said Robuck bearing date as aforesaid the which wee have
here in Court to produce wherein he the def^t: did bind himselfe his heirs executo^rs: or
Adm^rs: to pay unto Charles Tendall and John Walker the Sume of Thirteen pounds
Sixteen Shillings Sterling but he the said Robuck little regarding the aforesaid writeing or
promise but fraudulently intending the pl^t: to deceive of the Sume of Six pounds eighteen
Shillings doth deny & still doth deny to pay the same although often thereunto required by
The pl^t: whereupon the pl^t: Saith he is damnified & hath damage to the vallew of Thirteen
pounds Sixteen Shillings the like Money & thereupon brings his Suite &c^a: - - - -
And the said Robuck Lynch by John Taylor his Attourney cometh & defendeth the force
& injury when &c^a: and saith that the pl^t: his accon he ought not to have for that he never did
owe him the said Sume of Money as he declares for, but what he did owe he alwaise was ready
and is Still to pay him in this Country Comoditty according to act of assembly made & provided
Upon which came both parties by their Attournies aforesaid & by Mutuall Consent put them
selves to the judgment of this Court
Whereupon it is this day to witt the 14^th: day of November in the Xiii^th: yeare of the Domion
of the R^t: hono^ble:Charles &c^a: annog Domi 1688 ordered that Matthew Scarbrough & William
Round of this County Merchants Auditors to Audite their Acco^ts: & make report thereof to the
Justices of the next County Court &c^a: - - - - - - - - - - -
