The Same Day Comrs: as aforesaid 70
And the said John Moore by his Attourney Jno: Taylor cometh & defendeth the force & injury &a:
and prayeth libery to imparle hereunto untill the next County Court & it is granted to him the same
day is granted to the plt: likewise

At which Said County Court to witt the 16th: day of August in the Xiiith: year of the Domion of
Right honoble: Charles &a: Came the Said parties by their Attournyes aforesaid & the Said
John Saith that the said Butcher his accon he ought not to have for that he is noe waies guillty
of detaining any Cattell nor any thing else of the said Mary Butcher as declared & this
he prayes may be enquired off by the Country & the plt: alsoe
It is therefore Comanded that the sheriff of this County cause to come here Twelve good and
Lawfull men of his Bayliwick by whome the truth of the matter might been the better known
which being don the parties aforesaid cameby their Attournyes aforesaid & the Jurors: of the
Jury likewise Came (to witt) James Weatherly ffrancis Joyce Robert Crouch Thomas Tyre
John Richins Joseph Staton Phillip Ascue John Carsens John Hambly Marmaduck Mister -
Richard Webb & James Ingram who to say the truth in the premisses being Elected Treyed
& Sworne upon their Oaths doe say Wee of the Jury doe find for the plt: which verdict
was Ordered to be Entred upon which came Jno: Moore deft: aforesaid by his Attourny //
aforesaid and Crave an appeale to the Justices of the provinciall Court which was granted
him giveing Securitty According to Law

Wm: Brereton plt:
agt: Sumr:sett County Ss Capta: Henry Smith of this County was
Henry Smith deft: Attached to answer unto Wm Brereton of the same County
in an Accon of Trespass upon the Case/
And whereupon the said Wm: Brereton by James Sangster his Attourny complaines
& Saith that whereas the said William Brereton had in the yeare of our Lord one thousand
Six hundred eighty & five a black stone horse with a star in the forehead runing in the said
County Aged Two yeares or thereabouts bounded on the buttock with the letter W wch: Ltre
is the only brandmarke he alwaise usd to brand his horse withall & is knowne to be the
Only brand marke he hath usd ever Since he came to live in this County & long before -
which said horse Soe branded was by the said Capta: Smith in or About the Mounth of
June one thousand six hundred eighty & five branded on the aforesaid buttock upon =
The aforesaid brand mark of the said William Brereton with the letters H:S: which
is accounted & Lookd upon to be the brand marke of the aforesaid Capt: Henry Smith
but he the said Capt: Henry Smith intending utterly to defraud the said Willm: Brereton
of his said horse did by Henry Smith Junr: his son at or about the Twelfth of ffebruary
One thousand six hundred eighty & Seaven privately & fraudulently contrive & Send
Away the said horse to the Whoore Kilne out of this province Contrary to Law & the
Said Capt: Henry Smith by the said Willm: Brereton being often required to make Satisfie
for the said horse he the said Capt: Henry Smith hath hitherto & still doth refuse to do
The same Whereupon the said Willm: Brereton Saith he is damnified & hath losse
To the vallew of six thousand pounds of Tobao: & thereupon brings his Suite
Ja: Sangster Attourney pr quer. pledge de prosses John Doe
Richd: Roe
And the said Henry Smith by Thomas Poole his Attourney Cometh
and defendeth the force & injury of the plt: &a: & prayeth liberty to imparle hereunto
untill the next County Court & it is granted to him the same day is granted to the plt
