Now at this day (to witt) the 16^th: day of August in the Xiii^th: yeare of the Domion of the R^tt:
hono^ble: Charles &^a: came Symon Perkins Sen^r: by his Attourny James Sangster & defendeth
the force & injury of the pl^t: & praieth liberty to imparle to the next County Court & it is
granted to him the same day is granted to the pl^t: likewise
Upon w^ch: came Thomas poole atto^rny to the pl^t: as alsoe Symon Perkins by his attourney
aforesaid & both parties by Mutuall consent have put themselves to the judgment of the Court
Whereupon it was Ordered by this Court that Walter Lane of this County be Chosen Auditor
for to Audit the foregoing Acco^ts: & what ballance he finds Comeing due to the Same to make

ag^t: To answer unto Robert Butcher of the same County planter in

And whereupon the pl^t: by James Sangster his Attourney Comes & saies that he the af
Said pl^t: had Severall Chattles runing At the house of the said def^t: viz^t: One black Cow
with a Starr in her forehead marked by Rowland Bewins with her increase as one heifer with
her increase One steer of three years Old one yearling heiffer & one Calfe which said Cattel
The pl^t: had & was possessed with by his intermariadge with his late wife Mary Butcher deced
and raised at the plantacon of the said def^t: but he the said def^t: fraudulently & Craftily
Intending to deceive the pl^t: of the foresaid Cattell hath marked the said increase of the Said
Cattell in his owne marke & them unjustly detaineth from the pl^t: tho often of him demanded
Wherefore the pl^t: Sayes he is damnified & hath Losse for want of the said Cattell to the
Vallue of Three thousand pounds of Tob:^o & thereupon brings his Suite
