At which said County Court (to witt) the 16th: day of August as aforesaid Came the said
parties by their Attournyes aforesaid & the said Henry Smith saith that the said Brereton
his Action he ought not to have for the he never had any horse of the plt: as in matter & forme
declared and therefore puts the plt: upon the proofe of his declaracon
And the said Wm: Brereton Saith that he ought not to be debarred his Accon aforesaid and this
he prayes may be enquired off by the Country & the deft: alsoe
Whereupon Comand was given to the sheriff of this County to cause to come here Twelve
good and Lawfull men of his Bayliwick by whome the Truth of the Matter might be the
better known which being don The parties aforesaid Came by their Attournyes aforesaid
And the Jurors: of that Jury likewise Came (to witt) Samuell Collins ffrancis Joyce Robert Crouch
Thomas Tyre John Richins Joseph Staton John hambly Marmaduck Myster Nathaniell Vezey
Walter Reed John Christopher & Richard Samuells who to Say the truth in the premisses being
Elected Treyed & Sworne upon their Oaths doe say Wee the Jurors: doe find for the plaintiff
which verdict was ordered to be Entered upon which Came the aforesaid Henry Smith deft: &
Cravd an appeale to the Justices of the Provinciall Court which was granted him giveing Security
According to Law &a:~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~
// The Same Day Comrs: aforesaid
Ordered that the Constables of the severall and respective Counteys hundreds take the Non residence
of each hundred in their Custody vizt: the Constable of the hundred where any Non residence -
as aforesaid is, that the said Constable take him or them into his Custody & him or them Safe
Keepe untill they give good & Sufficient Securitty as well for the paying of their Taxes as for
