Not to have for That the said def^t: was never indebted to the said George Treherne pl^t: as in
manner & forme declared & therefore putts the pl^t: to the proofe of his declaration -
Whereupon came both parties by their Attournies aforesaid & by Mutuall Consent put themselves
To the Judgment of this Court Now at this day to witt the sixteenth day of August as aforesaid
This Court not finding the pl^t: acco^ts: provd according to Law Nor noe proofe on the part of
The said pl^ts: it was there Ordered that the said George Treherne take nothing by his writt
but A NonSuite granted to the def^t: ag^t: the said Treherne pl^t: & the said pl^t: to be in
mercy for his false Clamour &^a: - -

of Coll^o: W^m: Stevens late of this County deced in an Accon of the Case - -
And whereupon the pl^t: by her Attourny Thomas Poole Comes & sayes that he the
said Symon Perkins standeth indebted to the estate of the pl^t: the full & just Sume of =
Twelve pound Tenn Shillings & five pence Sterling Mony of England as pr acco^t: here
produced will in Court more plainely Appeare the which Sum he the said Symon did assume
upon himselfe & promised to pay unto the pl^t: when thereunto required by the pl^t: & alsoe
The said Symon Standeth indebted five hundred pounds of Toba^o: upon ballance of account
and One thousand feet of planck for Rent but he the said def^t: fraudulently intending
The pl^t: to deceive of the aforesaid Sume of Money Tobaccoe & planck doth deny & still
doth deny to pay the same although often thereunto required by the pl^t: whereupon the pl^t:
Saith she is damnified & hath damage to the valle of Twelve thousand pounds of Toba^o:
