Now here at this day (to witt the 16th: day of August as aforesaid Came Thomas Millman
by his Attorny Thomas Poole as alsoe George Treherne by Edward Jones his attorny came & both
parties by Mutuall Consent put themselves to the judgment of the Court
Whereupon it is this day Considered by this Court that the plt: his Accon ought not to have
his Attorney haveing not prformed the Rules of Court therefore have granted a NonSuite to

Wrong Entered Sumr:sett County Ss Thomas Millman of this County was Attached
accon Continued To answer unto George Trehearne in an accon detenu =
And the aforesaid George by his Attourny Edward Jones Saith that the said Thomas
hath in his possession One Cow & One yeareling beloning to the said George wch: Cow &-
yearling the said Thomas doth detaine & fraudently intending the plt: to deceive of the
said Cow & yearling although often thereunto required Whereupon the plt: Saith he is
damnified & hath Loss to the vallue of 1200lb: of Tobo: & thereupon brings his Suite
pr qr: Edward Jones
Whereupon Came Thomas Millman deft: by his Attourny Thomas Poole & defendeth
the force & injury of the plt: & saith that he never had any Cow or yearling of the plts: in
his Custody as in manner & forme declared the deft: puts the plt: to the proofe of his
declaracon Upon which came both parties by their Attournyes aforesaid & by Mutuall
Consent put themselves to the judgment of this Court
Now at this day (to witt) the 16th: day of August as aforesaid this Court finding noe Accots:
nor proofe on the plts: side ordered that the plt: take nothing by his writt but a non
Suite granted to the deft: agt: the said plt: & the said plt: to be in Mercy for his false

Came Thomas Gordon & made agreemt: in this Court for to have the daughter of Jenckin Morris
deced Called Elizabeth Morris untill she attained to the age of sixteen yeares or day of Marriadge
& that he in the interim wd: teach her to Read & bring her up in the feare of God as alsoe to teach
her the said Elizabeth to Knitt & Sow & other things that may be usefull for her which was granted
him &a: The same Day Comrs: as aforesaid

agt: Sumrsett County Ss Thomas Millman of this County was attached
Thomas Milman deft: to answer unto George Trehearne in an accon of the Case ~ ~
And the aforesaid George by his Attourny Edward Jones saith that in the yeare
1686 then the said Thomas became indebted unto the said George in the sume of Nyne
hundred & sixty pounds of Tobaa: & a halfe as doth appeare by accot: & heare in Court -
produced which Sume of Nyne hundred & sixty pounds & a halfe of Tobaccoe the said -
Thomas hath refused to pay & still doth refuse although often thereunto required where
upon the plt: saith he is damnified & hath Loss to the vallue of fourteen hundred pounds
of Tobao: & thereupon brings his Suite pr qr: Edward Jones
And the said Thomas Millman by his Attourny Thomas Poole Cometh and
defendeth the force & injury of the plt: & saith that the said plt: his accon he ought
