Thomas Jones by the Tenth of November Next or to his order eight hundred pounds
of Tobaccoe first debt & One hundred pounds of Toba^o: towards his forbeareance in
All Nine hundred pounds of Tobacco & caske which the said Peter Whaples binds
himselfe his heirs executo^rs: or Adm^rs: to pay the same Accordingly to the said Thomas
Jones his executo^rs: adm^rs: or assignes as Witness my hand & Seale the 3 day of
September Anno 1686 Peter Whaples (Seale
Testes Jn^o: Webb = Came Jn^o: Webb & made Oath that he attended the Court for
W^m: Stevens= the foregoing busness Six daies =
Now here at this day (to witt) the 16^th: day of August as aforesaid Came Thomas
Jones by his Attourny Edward Jones as alsoe Peter Whaples by his Attourny Thomas
Poole & both parties by Mutuall Consent have putt Themselves to the Judgment of
this Court Whereupon it is the same day Considered by this Court that the said
Thomas Jones recover against the aforesaid Peter Whaples the just Sume of
Nine hundred pounds of Toba^o: with cost als execucon & the defend^t: in Mercy &^a:

Sum^rsett County Ss George Treherne late of this County was Attached to answer unto
Thomas Millman in a plea of Trespass on the Case ~ ~
And whereupon the pl^t: by Thomas Poole his Attourny comes & Saith that he
the said George in the year of our Lord 1687 became indebted unto the pl^t: the full
& just Sume one thousand Three hundred Thirty &Three pounds of Toba^o: as pr
Accompt herr in court prduced as will in Court more plainly appeare the which acco^t:
he the said George did promise & assume upon himselfe to pay unto the pl^t: when thereunto
required but he the Said George fraudulently intending the pl^t: to deceive hath paid
Six hundred Twenty & five pounds of Toba^o: & the remainder he the Said George deny
To pay although often thereunto required by the pl^t: Soe that there remaineth due to
the pl^t: from the def^t: Seaven hundred & Tenn pounds of Toba^o: which he the said George
doth deny to pay Whereupon the pl^t: Saith he is damnified & hath damadge to the vallue
of 1400^lb: of Toba^o: & thereupon brings his Suite// Tho: Poole pr quer Jn^o: Doe }

And the said George Trehearne by Edward Jones his Attourny cometh & defendeth
the force & injury of the pl^t: &^a: & saith that the said pl^t: his accon he ought not
To have first That the said pl^t: Atto^rny did not file his declaracon according to the
Rules of Court Secondly that he Ought not to have it by Law as by an Act for preventing
of vexatious & unnecessary Suites at Law & Thereupon puts himselfe upon the Court
