had been out upon the said Robert Payne deced it was agreed betwixt the said Wm Robeson
and Thomas Holbrooke to putt themselves upon the judgment of this Court for the said troubles
and Charge & upon the same the said Thomas Holbrooke did at or upon July the 14th: deliver
the Said mare & ffoale into the said Robesons Custody yor: peticoner therefore humbly Craves
yor: Worships Judgemt: And he shall Ever pray &a
Robert Payne Dr: to Thomas Holbrooke Decembr: 24th: 1688 lb Tobo:
To dyett Washing Lodging & tendance from the 16th: of March till the 3rd: of June last 1200=
To the Cure of his Arme & Cure of his Legg & dyet from ye: 24th: Xber till ye: 5th: Janry: - 600
Errors: excepted pr Thomas Holbrooke/ 1800
Whereupon the 14th: day as aforesaid it was then & there Ordered by the Comrs: aforesaid
That mr: Stephen Luff one of the Comrs: aforesaid take the said account into his custody
and Regulate the same as he thought meet and allow what he thought fitt to the aforesd:
Thomas Holbrooke upon which it was then & there the judgment of the said mr Luff -
That the aforesaid William Robeson ought to pay unto the aforesaid Thomas Holbrooke
ffour hundred pounds of Tobao: upon the Accot: abovesaid Stephe which was confirmed
by the Court / The Same Day Comrs: as aforesaid

John Ellis Junr: Inditement Read vizt:
Somrsett County Ss The Jurors: for the Rtt: honoble: the Lord propry: being Sworne upon the holly Evangelist at
a County Court held the second Tuesday in June last past doe present and find that John Ellis Junr:
of this County planter did in the Mounth of March and upon the Third day of Aprill last past Clandestinely
and felloniously steale kill and Carry away Three barrow hoggs whereof Two of the said hoggs
were Two years & a halfe old and the other halfe a yeare Old of the vallue in all of six hundred
pounds of Tobo: which said hoggs were Cropt and Slitt in the left yeare and Swallow forke over
bitt and under bitt in the right Eare which is the proper marke of John Culhoone as alsoe the said
John Ellis is the Above said Mounth of March did felloniously and Clandestinly steale kill &
Carry away Two young shoates of about Nyne Mounth Old cropt and one Slitt in the left Eare
and upper halfed in the right Eare with a Notch at the Roote being the proper marke of George
Wilson and of the vallue of Two hundred pounds of Tobacco wherefore his Lordpps Attourney
Comes and Sayes that the said John Ellis Junr: hath not Only Offended Almighty God damnified
and injured his Lordpps good people and Especially his nearest and best Neighbours by frequent
Stealing and purloining their Creatures This being the second Offence, but alsoe hath occationed
Scandall and given Evill example to the good people of this province & most injuriously hath
Contemned his Lordpps good Laws & institucons Soe that Judgement Ought to be entred against
The said offender According to Law in that Case Provided Jam: Sangster Cl Indty
Upon which the said John Ellis Junr: appeares and Sayes that he is no waies guilty of what
is Laid to his Charge and for his Treyall puts himselfe upon the Country Whereupon it was
Ordered that a Jury be impannelled wch: was by the sheriff accordingly don vizt: James Weatherly
Walter Reed ffrancis Joyce Robert Crouch Thomas Tyre John Richins John Parsons Nathaniel
Vezey John Hambly Marmaduck Mister Richard Webb & Dunnock Dennis who being -
Impannelled and Sworne to say the truth of the matter according to the Evidences L of Robert
Hall James Browne who were alsoe Sworne and the Circumstance of George Wilson Doe
Say that the find John Ellis Junr: guilty of all except that of George Wilsons
Whereupon it was then and there Ordered that the said John Ellis Junr: pay to John Culhoone
four fould being 2400lb: of Tobao: in payment of 600lb: of Tobo: that the hoggs were vallued att
as alsoe that he receive on his bare back well laid on Three Stripes & that he stand in the
Pillory for Two houres all which was executed.
