Cattlin who to say the Truth of the matter doe Say & find for the Lord prop^ry: &^a
Whereupon the Same day (to witt the 13^th: day of June afores^d: It is the Judgment of
this Court that the said John Ellis pay for damage unto the parties agrieved four
fowle in Manner & forme following Vizt
for 3 Shoates about a yeare old of proper marke of John Rowell Cordwinder lb Tob:
vallued at 100^lb: of Tob^a: a peece is 300^lb: of Tob^o: w^ch: makes for the said Rowell} 1200
To one barrow of the proper marke of Robert Hall vallued at 250^lb: of Tob^o:
makes payable to the s^d: Robert Hall according to Act of Assembly - - - - } 1000
And the same day (to witt) the 13^th:day of June aforesaid it was further Ordered
by the Com^rs: afores^d: That the Sheriff of this County of Somersett County aforesaid
Take into his Custody the afores^d: John Ellis Jun^r: & upon his bare back well laid
on he give him Thirty Lashes which was accordingly performed as alsoe to keepe
him in his Custody untill he give good Security for his behavio^r & appearance next
Court as well as for his fine & all other Charges &^a ~ ~
The afores^d: day (to witt the 13^th: day of June as afores^d: it was further ordered by
The said Court as also Comand was given to the sheriff of this County of Somers^tt:
That he take into his Custody Jn^o: Ellis Sen^r: & Mary his wife & them Safe keepe
untill they give good security for thier behavio^r: & appearance next Court as also
for the said John Ellis fyne being 100^lb: of Tob^o: &^a ~ ~

By vertue of a recognisance taken before Capt^a: David Browne one of his Lopps
Justices of the peace for this County for Henry Smith of this County planter -
where complainte was made that the s^d: Henry Smith did clandestinly take & carry
away One gray horse belonging to Richard Kembell & then in the Custody of Henry
ffreakes of this County from the fence of Andrew Whittington of this County -
Inholder with bridle & saddle belonging to the said horse & other misdemeanors
by the said Smith comitted as will appeare by the Evidences to the greate detri
=ment of the said freakes breach of his Lopps peace & evill examples to his
Lopps good people Therefore his Lopps Attourney craves Judgement may be
Entered ag^t: the said Smith according to Law in that case provided &^a

Henry Smith was brought to the barr & being asked whether he was guilty of what
was laid to his Charge or not guilty pleaded not guilty & for his treyall put
himselfe upon God & the Country Whereupon Comand was given to the Sheriff
