Taylor did Oblidge himselfe to Make Over One hundred Acres of Land unto the plt: as -
will in Court more at large appeare as pr bond aforesd: but he the said Taylor fraudulently
Intending the plt: to deceive of the aforesd: Sume doth denye and still doth denye to pay the
Same or to make over the Land according to the Condition of the aforesd: bond although often
Thereunto required by the plt: Whereupon the plt: Saieth he is damnified and hath Damage
To the Vallew of 1500lb: of Tobao: and thereupon brings this Suite &t: - - - - -
And the Deft: Hope Taylor in prsona propria Cometh and defendeth the force & Injury
when &t: & prayeth Libertie to Imparle hereunto untill the next County Court & it is
granted him the Same day is granted to the plt: likewise
At which said Next County Court came the said parties vizt: Thomas Poole attorny to the plt:
as alsoe Hope Taylor Came in his proper person and saith that the plt: his accon he -
Ought not to have for that he saith that the said plt: never Came for to have the bargaine
prformed nor the said Land made over to him according to agreemt: & further the deft:
doth here averr in Court that the Condition of the said bond Obligatory was not read to
him in the Nature that Now it is when by him Signed and Sealed
And the plt: Saith that he ought not to be debarrd of his accon aforesd: it being the just -
agreemt: made with the deft:
Whereupon Came both parties vizt: Thomas Poole attourny to the plt: and Hope Taylor
likewise Came and both parties by Mutuall Consent put themselves to the judgmt: of this Court
Now heere at this day Vizt: the 13th: day of June in the Xiiiith: yeare of the Domion of
The Rt: honoble: Charles et. Annog Domi 1689 It is Considered by this Court that the -
said John Doe take nothing for his writt but be in Mercy for his false Clamour and
That Hope Taylor goe thereof without day And it is by this Court Ordered that the
said Hope Taylor recover agt: the said John Doe the Sume of Tobaccoe
for his Cost in this behalfe laid out according to the forme of the Statute &t:

Henry Lynch plt: Sumrsett County Ss Nathaniell Davis of this County
Accot= agt: was attached to answer unto Henry Lynch Mercht:
Nathaniell Davis deft: In an Accon of the Case &t:
And the plt: by his attourney Thomas Poole Comes & Saieth that he the said
Davis upon the Nynth of September in the yeare of our Lord 1683 became indebted to
The plt: the full and just Sume of Twelve hundred pounds of good Sound Merchantable Tobo:
and Caske it being due to the plt: for Severall goods & Merchandizes received of the plt: by the
Deft: as will in Couirt more plainly appeare as pr accompt here in Court produced ) but the -
Said Davis fraudulently intending the plt: to deceive of the Sume aforesd:doth denye & -
Still doth denye to pay the same altho often thereunto required by the plt: Whereupon the
plt: Sayeth he is damnified & hath damadge to the vallew of Two Thousand pounds of
Tobaccoe and thereupon brings this Suite &t:
And the Deft: by Peter Dent his attorny Cometh & defendeth the force and injury when &t:
and prayeth liberty to Imparle hereunto untill the next County Court and it is granted him
