for plea saith that he paid the 1200^lb: of Tobacco in his acco^t: Mentioned to the
pl^t: Viz^t: that he Ordered the said Tobaccoe to be paid him the said pl^t: by Randall
Revell late of this County deced
Upon w^ch: Came Thomas Poole attourney to the pl^t: and Natha^ll:Davis by his =
Attourney Peter Dent likewise Came and both parties by mutuall Consent put themselves
To the judgm^t:this Court
Whereupon it is Considered by this Court here that the said Henry Lynch recover =
against the said Nathaniell Davis as well the Sume of Twelve hundred pounds
of Tobaccoe and Caske debt as alsoe the sume of Tobaccoe for his Cost
of Suite and the def^t: in Mercy &^t:

Thomas Morris pl^t: the Def^t: not Appeareing Ordered that the sheriff be
Ag^t: amerced according to the Rules of Court &^t: - - -
William Innis def^t:

Thomas Poole pl^t: decl: read: both parties by Mutuall Consent have agreed
Ag^t: The Def^t: paying the Charges which he promissed =
Andrew Speer def^t: In Open Court &^t: - - - - -

Andrew Whittington pl^t: Sum^rsett County Ss William Harvey of this
ag^t: County was attached to Answer unto Andrew
William Harvey def^t: Whittington inholder in
And Whereupon the pl^t: by Thomas Poole his Attourney Comes & sayth that
he the said Harvey in the Mounth of August last past that he did faithfully -
Promise to pay unto the pl^t: the full and just Sume of ffour hundred pounds of Toba^o:
upon the accompt of Thomas Cartright late of this County deced but the said Harvey
Little regarding his promise or assumption but fraudulently intending the pl^t: to deceive
of the Sume afores^d: doth denye to pay the same altho often thereunto required by the
pl^t: whereupon the pl^t: Saith he is damnified to the Vallew of 800^lb: of Tob^o: and
Thereupon brings this Suite / ord^r: read
William Harvey Pay unto Andrew Whittington and John Webb each man four hundred
Pounds of Tobaccoe and Charge it to the acco^t: of yo^r: Loveing frind Tho: Cartright
Sept^m: the 11^th: 1688
And the def^t: by Edward Jones his Attourney Cometh & defendeth the
force and injury when &^t: and prayeth Liberty to imparle hereunto Untill the
next County Court and it is granted him the same day is granted to the pl^t: likewise
At which said Court Came the said parties by their Attournyes afores^d: and the said
William Harvey by Edward Jones his attourney sayth that the def^t: did not prmise
Nor assume to pay any Tobacco for the said Cartright and desires that the pl^t: may
put to the proofe of hs declaration
