Thomas Highway
// The Jurors: for the Rt: honoble: the Lord propry: being Sworne upon the holly Evangelist
at a grand Jury held for the body of this County the Second Tuesday in November last =
past doe present and finde that Thomas highway of this County on the 13th: day of August
Last past did Clandestinely goe to the Marsh adjoyning to the high Lands of the plantacon
Where Andrew Speere doth Now live & then & there the said Thomas highway did
Take out of his pockett Some Corne and there did privately call five hoggs belonging to the
Said Speare & with Corne did Tole them in the Thickett of woods whereof the said hoggs
In Eateing of Some Corne throwne to them the said Thomas Highway id Catch up one of
Those Hoggs a Shoate about Ten Mounths old and the same did kill and Carry away the
Said Speare heareing the Shoate give One Squeake Now his Lordpps Attourney Comes &
Sayes that the said highway hath broken his Lordpps good Lawes & is become guilty
of hogg Stealeing and requires judgmt: agt: the said highway as in Law provides in Such
Cases &t: The hogg vallued at one hundred pounds of Tobacco &t: - - - - - -
Upon which Came Thomas highway in his proper person and pleades not guilty & for
Treyall puts himselfe upon the Countrey
Whereupon Comand was given to the sheriff of this County to cause to Come here Twelve
good and Lawfull men of his Bayliwick by whome the truth of the Matter might be
The better knowen and who Neither &t: to recognize &t: because as well &t: - - - - -
Now here at this day (to witt) the 12th: day of June in the xiiiith: yeare of the Domion
of the Rt: honoble: Charles &t: Annoge Domi 1689 Came the aforesd: Thomas highway
and the Jurors: of that Jury likewise Came vizt: John King Rowland Beevens Robt: Smith
John Townesend Senr: John Emmitt John Bowin William Clarkson George Phebus =
George Bosman Walter Taylor Henry Hayman & Myles Harrison who to Say
The truth in the premisses being Elected Treyed and Sworne upon their Oaths doe Say
Wee of the Jury doo find Thomas highway not guilty of matter of fact - -

The Lord propry: This Court finding noe Cause of inditemt agt: the deft: therefore
agt: Cleared paying his ffees &t:

The Lord propry Ordered he give Security for his behavior: & appeare next Court
agt: Came Wm: Seamore wth: his Sureties John Webb & Jno: Townesend
William Seamore and did acknowledge themselves to stand indebted unto the Lord propry:
Vizt: W,: Seamore in the Sume of Thirty pounds Sterl: and Jno: Webb & John
Townesend in the Sume of fifteen pounds Sterling apce to be Leavied on their goods &
Chattles Lands & Tennements for the use of his Lordpp
The Condicon being Such that if the Above bound Wm: Seamore be of the good behavior: as alsoe make
his personall appance next Court then the above Obligacon to be void Otherwise to be in full ---
