At A Cort of adjournement held the 5th day of ffebruary 1683 Commrs present as ffolloweth

John Tully deft John Tully being Called doth not appeare neither by himself nor attorney whereupon the plte
by his attorney humbly Craves a attachmt this being the second writt returned by the
Sherife n est Invts Whereupon y Cort: Commanded the plte to proseede &c

Somrsett County Ss John Tully late of this County was attached to answr unto Robert Hall in A plea
of Debt &c.
And whereupon the plte by Thomas Poole his attorney Comes & Saith yt he the sd Tully upon
the 23th day of July in the year of or Lord 1683 became indebted to the plte the full & just summe of
fourteen hundred pounds of Soand marchantable tobacco & Caske to be pd Convenient in Pocomoke river
unto the plte or his order at or upon the Tenth day of october next ensueing after the Date of a bill wth
wee have here in Cort to produce under the hand & Seale of him y sd Tully bearing date as aforesaid wherein
he the said Tully Did bind himselfe his heirs executors & assignes to pay the aforesaid Summe of 1400lb of
tobo unto the plte according to the tenor of y aforesaid bill but he the sd Tully little regarding his bill promise
or assumption but fraudulently intending the plte to deceive of the Summe aforesaid doth deny & Still
doth deny to pay the Same although often thereunto required by the plte whereupon the plte Saith he
is Damnified & hath Damadge to the vallue of 2800lb of tobacco & thereupon brings this Suite : / :

This bill proved in am holden and firmly bound me my heirs executors administrators & assignes unto
Cort the 8th day of Robert Hall of the Same County his heires or assignes the Just and neat quantity of
January by John ffourteene hundred pounds marchantable and tobacco Caske to be pd Convenient in Pocomoke
Makettrick & Sampson river unto the Said Robert Hall or his order at or upon the10th day of october next ensueing
Allen the Date hereof and for the true performance of these presents I binde me my heires executors
and assignes as wittness my hand & Seale this 23rd day of July 1683 John Tully Seale

County in a plea of Debt &c
And where upon the plte by Thomas Poole his Attorney Comes & Saith that he the Sd Edward upon
the 23th day of Aprill in the year of or Lord 1681 became indebted unto the plte the full & Just -
Sume of Six hundred pounds of good Sound marchantable tobacco & Caske to be payd the tenth day of
october next ensueing after the Date of a bill wch wee have in Cort:to produce undr y hand of
him the Sd Edward bearing Date as aforesaid wherein y Sd Edward did binde himselfe his heires
executors & admrs: to pay the aforesaid Summe of tobacco according to y tener of y aforesaid bill
but he the Sd Edward Little regarding his bill but fraudulently intending the plte to deceive of y
Sume aforesd Doth denie & Still doth denie to pay the Same although often thereunto required
by the plte whereupon the plte Saith he is Damnified & hath Damadge to the value of one thousand
pounds of tobacco & there upon brings this Sute Jno: Doe

bill read vizt This bill bindeth me Edward Smith of Boquetenorten in Somrset
County me my heires executrs & admrs: to owe & Stand firmly indebted to John Rhodes of New deale
County in the Province of New York him his heires executors admrs or assignes the full & just
Sume of Six hundred pounds of good Sound marchantable tobacco & Caske to be pd at or upon
the Tenth Day of october next ensueing the Date hereof at Some Convenient Landing in
Pocomoke
