the 9^th day of y month Called January 1682 To be the act & deed of the
Said Edward Smith Test W^m Clarke Cl^rK^t
Plea Rhodes plt Smith def^t And whereupon y def^t by his attorney James Langster Comes & Sayes
y^t he the S^d Rhodes plt Judgem^t ought not to have because the def^t became indebted the Sume of tobacco for
one Cowe & Calfe being properly y estate of Ambrose White deseased and the S^d White deseased having employed
the def^t to transport his tobacco & other necessaries to Pocomoke river in refference to Satisfaccon for y sd Cow & Calfe to y value of 420^lb: of tob: as will appeare by acc^ot now y S^d Rhodes Comeing to y S^d Estate did agree with
y def^t y^t the S^d bill for y S^d Cowe & Calfe Shoulld be void when as the S^d def^t have ord^d of Co^st for y 420 ^lb of tob:
due from the S^d: estate y remainder y S^d Rhodes woulld take out in y Like worke of transporting w^ch accordingly
y def^t hath done to y value of 920^lb of tob w^ch is in all to y Sume of 740^lb tob and w^ch acc^o: wee are ready to
swear to & avowth y agreement Langster pro def^t

Somersett County Ss Oliver Berry Late of this County Marriner was Summoned to answ^r unto John
Cropper in a plea of Trespass upon the Case &c
And where upon the plte by Thomas Poole his attorney Comes & Saith That he the Said Oliver in
the month of ffebruary last became indebted unto y plte the full & Just Summ of Two Thousand one
hundred & Seaventy pounds of good Sound marchantable tobacco & in order to y payment of y aforesaid
Sume of 2170^lb of Tobacco unto y plte he the S^d Oliver did Charge A note upon Coll^o: W^m: Stevens w^ch note wee have
here in Co^rt to produce but he the S^d Oliver fraudulently intending the plte to deceive of the Summe
aforesaid (meeting) with Coll^o Stevens ordered him not to except the note afores^d w^ch he the S^d: Oliver
had Charged Soe y^t the plte is Still unpaid or Satisfied y Summe of 2170^lb of tobacco although often there
unto required by the plte whereupon the plte Saith he is damnified and hath Damadges to the vallue
of 2400^lb of tobacco and thereupon brings this Sute Jn^o: Doe

Coll^o: Stevens So be pleased to pay m^r: John Cropper twenty one hundred and Seaventy pounds of tobacco upon
my acc^ot: and I will pay you the Same or in any thing else that you Shall require you^r Serv^t: to Command

These Presents Witnesseth that if Oliver Berre Doth pay unto Henry Smith the sume of Two Thousand
one hundred & Seaventy pounds of tobacco the remainder of Two Thousand and five hundred pounds of
tobacco that the Said Berry did agree for to give unto Jn^o: Cropper for his Damages y^t he the S^d Jn^o: Cropper
Shoulld Sustaine by Joane Garretts being with Child the w^ch Chilld the S^d Joane doth Charge the S^d
Berry to be the father thereof that then this presents Shall witness that I the said John doth Clearly
acquitt and dischardge the S^d Oliver Berry from all Damadges y^t I Shall Sustayne by the S^d Joane
being with Child as witness my hand & Seale this 5^th feb^ry 1682/3 John Cropper
