At A County Cort of adjournmt helld the 28th day of november in the eight year of the Dominion of y Rt

mr Wm Brereton ingaged to pay the Cost & damadges for Thomas Bird
if in case he be cast: & thereupon plte & deft: Joines issue to be tryed
by the Cort: Decla: read vizt
Sommersett County Ss William Piper late of this County was attached to answr unto Thomas Bird
in an accon of Trespas upon the Case &c
And whereupon the plte by Thomas Poole his attorney Comes & Saies that he the Piper in the year of or Lord
1683 Did borrow of the plte Severall blocks and Riggen & other necessaries for the fitting out of his
vessell as will in Cort more plainely appear as pr accot here in Cort produced but he the said Piper
fraudulently intending the plte to deceive of the aforesaid blocks & Riggen he the Sd Piper doth
deny & utterly refuse to deliver the aforesd Riggen unto the plt although often there unto required
by the plte in kinde as recd: by the deft: whereupon the plte Saith he is Damnified & hath damage
for want of those necessaries to y value of Six Thousand pounds of Tobacco & thereupon brings

Tho: Bird And the said William Piper by Josias Seaward his Attorney Comes
ag: plea and defendeth the foresd Injury & Saith:
Wm Piper
That he the abovesaid Wm Piper did not borrow any Such goods as the above named Tho.
Bird declareth he Lent in y year 1683 but in the month of nbr 1682 Tho Bird Came to the
Sd Piper & desired the Sd Piper to alter his Sloope & make her a barque at wch request the sd Piper
replyed yt he Shoulld want both riggen & Sayles & blocks to doe itt y Said Bird answers he
had old roapes & Sayles in york River virga enough to doe it & promised the said Piper yt
if he woulld Send his Shallop for them he Shoulld have them for to fix his vessell the Sd Piper
then replyed yt it may be he will aske more for them then I Can buy now roapes &c for in Engl
he the sd Bird Answerdd that I the Sd Piper Shoulld have them Reasonable & Likewise for yt wee
Shoulld not fall out about itt upon wch discourse the said Piper victualled & mann'd his
Shallop & Caried Tho: Bird to York river & theire tooke in what ropes & Sayles &c y Sd bird had
theire & brought them for Maryland & put them on board the Sloope & the said bird did alter
the Sloope & put in three masts (but orderdd the Carpentr: to make them to Short & small Soe yt
I am at the Charge to make new masts) & riged them with Some of thees old roapes &c & the
Sloopes riggen & Cutt Some of those roapes for the vessells use & Likewise Cut the Sayle & fitted
it to the vessell & the said Piper ordered the said Bird to keepe an exact Accot of what roapes &c
he made use of on the vessell for the said Pipers use wch he promised the said Piper he woulld
doe & Accordingly he Charged them to an accot Such an one as it is & gave it to y Said Piper in
the month of Janry 1682 & then Sayled with y said vessell for the barbadoes and back
againe to Maryland (though Long taryeing there) & then unriged the vessell & delivered
the Sayles & Riggin into y Sd Pipers house & posession soe yt the Sd: Piper leaves it to y worpll
Court to Judge whether or not those Sayles & ropes were not bought by the said Piper
The deft Craveth y worpll Court Judgemt if the above said Thomas bird his
