Sommersett County Ss: William Mason Late of this County was attached to answ^r unto Robert King marchant
in an accon of the Case upon Acc^ot
And whereupon the plte by Thomas Poole his Attourney Comes and Saies That he the said Mason in the year
of o^r: Lord 1682 became indebted unto y plte the full & Just Summe of Three Thousand one hundred
& five pounds of Tobacco & Caske to Containe y Same it being due to the plte for Several goods &
marchandizes delivered by the plte unto the def^t as pr acc^ot here in Co^rt produced will more plainly
appear the which Acc^ot the def^t did faithfully promise to pay and Satisfie unto the plte when
thereunto required but he the said Mason Little regarding his promise but fraudulently intending
the plte to deceive of the Summe aforesaid of 3005^lb of Tobacco doth denie & Still doth deny to pay
the Same although often thereunto required by the plte whereupon the plte saith he is Damnified
& hath Damadge To the vallue of 5000^lb of tobacco & thereupon brings this Sute.

from Daniell Browne &c
And thereupon this Co^rt orders that the def^t William Mason pay unto y plte m^r Robt
King or his order Two Thousand one hundred & five pounds of Tobacco & Cost of Sute
alias execucon Alwaies Provided y^t if m^r Daniell Browne Comes & Claimes any thing
in y Said acc^ot Contained of W^m Mason def^t That the plte m^r Robert King save harmless
& defend y Said W^m Mason from the Said Daniell Browne ~ ~ ~ ~ ~ ~
