The aforesaid Robert refuseth to pay y aforesaid Summ of 1000lb of Tobacco although often thereunto required
whereupon y plaintiffe saith hee is Damnified & hath Dammadge to y value of Two thousand pounds of Tobacco

Same County & Province hee or his assignes y full & just summ of one Thousand pounds of good sound mer:
chantable Tobacco with Casqe to Containe y same itt being Due for a valuable Consideracon allready in
hand received and y same to bee payd upon y tenth of november which Shall be in y yeare of our Lord God

thirty pounds of Tobacco which hee owes & unjustly Detaineth &c : / :
And whereupon y Said Thomas William Greene by his attorney Thomas Poole saith yt hee y aforesaid Robert in y
yeare 1674 upon y fourth Day of february Did Assume upon himselfe & Did bind himselfe his heirs execrs:
admrs: to pay or Cause to bee paid unto y aforesaid Greene his heirs executrs: or admrs: four hundred & thirty
pounds of good Sound merchantable tobacco with Casqe being for a valuable Consideracon in hand received
by him y aforesaid Robert as in Cort: under his hand & seale will appeare but hee y said Robert little regarding
his promise & assumpcon but fraudulently intending him y aforesaid Greene to Deceive of y aforesaid~
Summe of 430lb of Tobacco Denyeth & Still Doth to pay y Same although often thereunto required where-
upon the plainteffe Saith hee is Damnified & hath Damage to y value of nine hundred & Sixty pounds
