Walter Lane of the Said County in an accon of the Caase : / :
Whereupon the said Walter Lane by himselfe That he the said Colebourne became indebted
unto him the said Lane The full Summe or quantity of one Thousand foure hundred & -
seaventy pounds of Tobacco as pr his Acc^ot here in Co^rt produced more plainely doth appeare -
W^ch: Summe of Tobacco as aforesaid the said Colebourne hath not paid though often there unto-
required whereby the plte Saith he is Damnified & hath Losse to y Summe of Two Thousand
nine hundred & forty pounds of Tobacco thereupon brings his Sute ; / ; ~ ~ ~ ~ ~ ~

And this day to witt y 9^th day of August Annoq Do^m 1676 the Said Coll^o W^m Colebourne by
his Attorney Edward Jones Cometh & defendeth the force & Injury &c and Saith y^t he hath paid
& made Satisfaccon for what the plaintiffe hath Donne &c ~ ~ ~ ~ ~ ~
And the plaintiffe desires his acc^ot may be read: vizt

To Soe much due to me for Saylering in his boate & writing for him from
y 3^d day of october 1673 untill y 14^th october following by agreem^t 400^lb of tob:} 400 By A paire of Shoes rec^d
one pare of Shoes & one pare of Irish Stockings of W^m Greene
To Avoyadge he imployed me to great Manny to fetch tobacco belonging to m^r:Areskine } 120
commenc^d: June y 18^th 1674 & ending y 22^th of y same Instant being 4 dayes at 30^lb tob: pr diem
To A voyadge he Imployed me to goe to Boquetenorton in his Shallop & to write By A pare of Irish
for him & keepe his bookes having goods to Sell on board of 50^lb tob pr diem Comenced Stockings rec^d

And the Said Walter Lane makes oath upon the holy Evangelist before the Co^rt that he hath received no
Satisfaccon for the same but what he hath given Creditt in the same ~ ~ ~ ~
And thereupon This Co^tr ord^rs: that Coll^o W^m Colebourne pay unto Walter Lane or his order one Thousand
ffoure hundred & seaventy pounds of Tobacco with Cost of Suite ~ ~ ~ ~ ~
Whereupon the Said Coll^o: Colebourne appeales to the hon^rble Justices of the Provinciall Co^rt And
this Co^rt: ord^rs: That the Proceedings here be sent over to the hon^rble Justices of the Provincial Co^rt
the appealant giving Security according to Act of Assembly ~ ~ ~ ~ ~

Cometh & Saith That the Tobacco attached of Thomas Hemmings in the hands of John Williams &
Robert Houston is his Tobacco by assignm^t from Thomas Hemming &c ~ ~ ~ ~ ~
This Co^rt findes five hundred & fifty pounds of tobacco in John Williams hands & ffoure hundred
& five pounds of Tobacco in the hands of Robert Houston And ord^rs: the same to be delivered & paid
to William Brittingham ~ ~ ~ ~ ~ ~ ~ ~ ~ ~
