John Goldsmith became indebted unto the said David Browne in the full & Just summe of three
hundred twenty & nine pounds of tobacco & Caske as doth appeare by a Certain Instrument of
writing bearing Date the 31st day of December Annoq Dom 1674 by the wch the said John did
binde himselfe his heires executors & admrs firmly to pay the foresaid Summe of 329lb of tobacco
Convenient in Manoakin river at or before the 10th of october ensueing ye Date of ye said writing
but the said John fraudulently intending ye said David Browne in that behalf to deceive
denieth to pay the aforesaid sume of tobacco with Caske whereupon the plte Saith he is
Damnified & hath Losse to ye vallue of Six hundred fifty & eight pounds of tobacco & Caske
& thereupon brings his Sute;/; ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~
Somersett Ss know all men by these presents that I John Goldsmith of Manoakin of ye County of
Somersett in the Province of Maryland plantor: doe owe & Stand Justly indebted unto David
Browne of ye County and Province aforesaid in the full & Just summe of three hundred twenty
& Nine pounds of good Sound Tobacco with Caske it being for a valuable Consideracon in hand
recd to be paid Convenient in Manoakin river at or before the Tenth day of october next
ensueing to the Said Browne his heires executors admrs To wch paymt well & truly to be
made I doe hereby binde me my heires executors & admrs firmly In witnes whereof I have
hereunto Sett my hand & Seale this 31th: of December Ao: 1674 - John Goldsmith (Seale)

And the same day to witt y 8th day of ffeb:ry Ao Dom: 1675 came ye deft Jno: Goldsmsith &
Confest Judgemt for the said three hundred Twenty & nine pounds of tobacco wth Caske
being Due from him to the Said David Browne, Whereupon this Cort orders that the sd
John Goldsmith pay unto the said David Browne Three hundred Twenty & nine pounds of
Tobacco with Caske according to his engagement with Cost of Suite alias execucon. . .

Maryland Somr:sett Ss Thomas Hemming late of this County Hatter was attached to answr: unto
Wm Brittingham of Northampton County in Virginia in a plea of Debt.
And whereupon the Said William Brittingham by his Attorney Thomas Poole Saith that the said Tho:
Hemming doth owe & Stand indebted to him y Said William the full & just Summe or quan-
tity of one Thousand foure hundred pounds of good Sound Marchantable tobacco in Caske
as pr A Certaine writing here in Cort produced more planiely will appeare Signed with y
hand & Sealed with y Seale of him the Said Thomas Hemming bearing date y 25th: day of
August Annoq Dom 1675 wherein the Said Thomas did assume upon himselfe & promise to
pay unto the said William his heires executrs: admrs: or assignes ye Sd quantity of 1400lb of
Tobacco upon demand after the 10th day of October next ensueing the date of the said writing -
Conveniently in Pocomoke river & for the True performance thereof he the said Thomas -
bindes himselfe his heires executors admrs or assignes, but he the said Thomas Little regarding
his promise & assumpcon fraudulently intending to deceive him the Said William of ye
Said 1400lb of Tobacco denyeth and Still doth to pay the Same although often thereunto requi-
red the plte Saith he is Damnified and hath Damadge to ye vallue of Two Thousand Nine
hundred pounds of Tobacco and from thence he produced his Suite ~ ~ ~ ~ ~
